10. While the concept of “interference” is broad – encompassing various forms of restrictions, penalties and formalities imposed by State authorities – it is closely linked to the existence of a chilling effect on the exercise of freedom of expression. The Court has consistently held that purely hypothetical risks are insufficient to establish such an interference (for examples of concrete interferences, see Schweizerische Radio- und Fernsehgesellschaft and Others v. Switzerland (dec.), no. 68995/13, § 71, 12 November 2019, and the references cited therein).
11. In the present case, the applicants merely alleged that the decisions in question would have a “chilling effect”. However, there is no evidence in the case file that such claims were subsequently borne out by concrete developments. The Court notes, in particular, that (a) there was no prohibition on broadcasting the disputed programme; (b) the Complaints Authority explicitly stated that referencing the impugned decisions would suffice; (c) the applicant company was not required to remove the disputed programme from its electronic archive; and (d) the only obligation imposed on the applicant company was to inform the Complaints Authority of the measures taken to prevent similar breaches in the future.
12. In the light of these considerations, the Court finds no evidence of a chilling effect in the present case. Consequently, the contested decisions cannot be regarded as amounting to an “interference” with the applicants’ right to freedom of expression.

today’s information came out piecemeal, and people should be able to share their own situations on their own time, but I could share this much ^ as it is pretty cut and dry on the facts.

Ich stimme auch zu, dass sich bei Suchmaschinen noch weitere Fragen stellen.

Ich würde aber davon ausgehen, dass viel mehr im Rahmen dieses Gesetzes nicht möglich ist. Bei zu vielen Forderungen auf der einen Seite und Widerstand gegen Regulierung auf der anderen fürchte ich den Absturz der Vorlage

Gibt es eigentlich Daten bezüglich Nutzung Login bei Suchmaschinen? Und ich bin nicht sicher, wie wichtig dieser Aspekt ist, wenn es um Transparenz zu Werbung und Algorithmen geht (Tracking ist ja auch ohne Login möglich).

2) Und warum sollen Regeln zu Empfehlungssystemen, Werbung, Transparenz (AGBs, Berichte), systemischen Risiken, Anlaufstelle, Rechtsvertretung, Datenzugang etc. für Suchmaschinen nicht funktionieren? Auch der DSA wendet die auf VLOPs und VLOSEs an.

Insofern verstehe ich diesen Kritikpunkt nicht.

Der Aussage zum Einfordern der Anwendung auf KI stimme ich zu, das Problem der Anwendung auf Suchmaschinen sehe ich (noch?) nicht.

1) Die Vorschriften für Moderation im VE-KomPG betreffen nur Plattformen, nicht Suchmaschinen.

Es gibt zulässige Einschränkungen der Meinungsfreiheit.

Davon abgesehen: Im vorgeschlagenen Gesetz geht es NICHT um staatliche Regulierung von Inhalten, sondern um Mindestvorschriften und Sorgfaltspflichten für private Plattformunternehmen. Und zwar auch um Overblocking zu verhindern.

Grundsätzlich einverstanden - mit der positiven Würdigung und den Verbesserungsvorschlägen.

Aber ich würde davon ausgehen, dass die Bestimmungen auch für KI-Suche gelten. Oder nicht? Auch die EU prüft ja, ChatGPT als VLOSE einzustufen, was dann Pflichten zu Risikoprüfung und Datenzugang beinhaltet.
