I am listening to the US Secretary of State. He is being asked under what legal authority the United States is authorized to run Venezuela. His replies indicate contempt for the question: he speaks only the language of power. This is where we are.

cackling at the inevitable dude standing up in row QQ, spilling beer on the nice family in front of him, yelling THAT'S A WALK
Instead of whatever this is, we should have a government getting lots of new homes and apartments built, lots of clean energy built, lots of high speed rail and transit and bike lanes built, human rights for everyone, economic & healthcare opportunities for all, & innovation that leads the world.
I feel like I haven’t even been properly lied to about the purposes of this war
We haven't seen an Indiana squad turn back an Alabama offense this decisively since Antietam
BREAKING

The Trump administration says it has frozen all childcare payments to Minnesota in the aftermath of allegations of fraud by some in the Somali community.

Important: allegations along these lines have existed for years, which has resulted in prosecutions starting with the Biden DOJ.

Ok, so, no, CLE is not helpful to clients, and it’s an expensive and time-consuming intrusion into every lawyer’s practice. But does it help lawyers stay current on the law? Also no.

I would read a Tampa Bay Times or Miami Herald response story investigating the best way to spend an afternoon in Florida in which you drink 8 beers and have a $475 budget. 4 guys on a fishing charter? Pedal keg bus through Ybor City or Coconut Grove?

I think I'm a linux user now? And not for nerd reasons, but for normie stuff like work and games? Is linux on the desktop finally here?

Welcome to quantum (or Daoist) contracts. The true contract cannot be fully known.

Emperor Clothing ETF mysteriously not listed
Of all the ETF slop, I can’t believe this is the one that can’t get listed.
USPS quietly changed its postmark rules — mail is no longer dated when you drop it off. The “official” date is when it hits automated sorting — sometimes days later

Which could have major implications for mail in voting — it’s a clever way to disenfranchise voters that’s going largely overlooked

Flashlight marketing has gotten out of control.

There's space for a "i'm pro-masking because I know the air pollution science, you're pro-masking for cultural reasons, we are not the same" take but a) that's not what Jon is doing and b) just because there's space doesn't mean you should use it.

don't want to get super deep on Jon Stewart mask discourse but one of the main takeaways from 9/11 first responder fallout was that more people should be wearing more respiratory PPE more often than they think they should.

it's disappointing to see him culture punching over it.
My new article with @cary-coglianese.bsky.social, titled "Loper Bright's Disingenuity," has been published in the University of Pennsylvania Law Review. We argue that, even as the Loper Bright decision claimed to overrule Chevron, it preserved Chevron's core.

Broke: Donald Trump is not barred from higher office by the constitution
Woke: SCOTUS and Congress failed to uphold the constitutional ban on Trump to hold office
Bespoke: The People failed to uphold the constitutional ban on Trump to hold office

Some credit. Student will miss out on a few points I give for citing authority, and a modest chunk for writing and following exam rules. But they'd get most of the substantive points.
this @jadler1969.bsky.social post is a great summary of the Frost-Eason paper’s findings

Maybe the real numbers were higher but the police are incompetent or corrupt, and aren't reporting the data. Only private detectives can get justice!

When this happens to you it is technically known as Collateral Kavanaugh Estoppel

Kavanaugh stops what he's doing, is all about to ruin, the image and the style that you're used to.

How did hard boiled private detectives make a living in 1940s San Francisco with only 28 killings a year? Even if every one of them were a rich heiress or a tycoon caught in a love triangle, that's not many cases!

It's funny how us parochial Americans generally seem to perceive that the EV revolution is stalling or reversing when in fact it's accelerating rapidly worldwide. 25% of cars sold globally in 2025 were EVs!

It's mostly just the US that's being left behind
I count 10 cities in 2025 that are on track to have the fewest murders since at least 1970. Newark is on pace to have the fewest murders since 1956 (though only have data through Oct this year) and San Francisco is on pace to have the fewest murders since 1942.

I suppose lawyers hired by a company represent employees in criminal proceedings where both the corp and the employee could be liable all the time. Of course employee should get their own lawyer but consent to corp representation is, I think, not uncommon.

Professional responsibility faculty colleagues, is it unethical to negotiate terms in a plea deal for a client that specifically shield your own criminal activity? Is it a conflict to represent your co-conspirator?
It is. You can actually search visible text on the redacted documents and the completely UNredacted document appears in the results 😭
