It seems to me he is using the method of lawyering, not a method of research. That is very wrong
This is a law professor who has never written anything of substance in criminal procedure, criticizing other law professors across the ideological spectrum who have taken him to task for his evident confusion about it. He has called them silly and now alleges that they’re biased and cartelizing.

I keep thinking “my god the people they’ve killed seem like exceptionally good folks” and I think the lesson there is that they’re not exceptional, but that wonderful people abound and that a baseline distrust in humanity is a shitty conservative trope that privileges power over collective strength

I agree that we can’t make Alex Pretti a Benedictine monk because that’s a trap, but we can talk about the good things we did because people will see and hear them and think “I do those things too”

Reminder: All it would take to end the murder of American citizens by an untrained government goon squad is 16 Republicans in Congress voting with Dems to defund ICE (or 23 to impeach and remove Trump — 3 in House & 20 in Senate). That’s it. 23 Americans can vote for the public and end all of this.

DHS has issued a statement, which very shortly, will be proven not to be true in all respects because that is what has happened with every ICE involved shooting so far. That is actually how reporters should describe any statement made through a DHS social media account.

I'm on the Green Line towards downtown Minneapolis ICE OUT protest.

The train filled immediately. Even 20 stops away from our destination we reached capacity.

People are cheering at every stop when they see people waiting to board because we are all starting to realize how big this is.

If you cite white supremacist segregationists in support of your position, that should be absolutely disqualifying in terms of both this specific debate and any other. This is a moral abomination.
I’ve criticized Ilan for not doing source criticism. Now, he’s endorsing the Trump Administration’s bad historical methods. Not only are they just throwing random people’s opinions at the wall— long after the ratification of the 14th Amendment— but they’re citing white supremicist segregationists!

It's precisely because we respect the "academic enterprise" that we criticize someone who proudly states that they're just trying be edgy and provocative by lazily churning out a half-baked historical argument in service of authoritarianism.
I want to address my friend Ilan who says here that he has been subject to “a lot of hate” from academics who “should know better” and haven’t respected the “academic enterprise.”

I don’t dislike Ilan. I also think his paper is fundamentally wrong and not scholarly.
