ICE agents get a name back from face recognition and multiple agents start calling out "Maria! Maria!" to see if a woman in custody reacts. (Presumably if she does that's a match???)

It didn't work, so they ran the app again and got another name.
In Oregon testimony last year, an agent said two photos of a woman in custody taken with his face-recognition app produced different identities. The woman was handcuffed and looking downward, the agent said, prompting him to physically reposition her to obtain the first image. The movement, he testified, caused her to yelp in pain. The app returned a name and photo of a woman named Maria; a match that the agent rated “a maybe.” Agents called out the name, “Maria, Maria,” to gauge her reaction. When she failed to respond, they took another photo. The agent testified the second result was “possible,” but added, “I don’t know.” Asked what supported probable cause, the agent cited the woman speaking Spanish, her presence with others who appeared to be noncitizens, and a “possible match" via facial recognition. The agent testified that the app did not indicate how confident the system was in a match. “It’s just an image, your honor. You have to look at the eyes and the nose and the mouth and the lips.”

However, originally the focus was on -- the focus was, for my arguments, was originally on the standard -- whatever was in the prior submissions because of this change, I felt because of something called, which I believe -- and again, there isn't much case law about it. But it is the concept of estoppel, and it is used in the context of unions and pension funds where if you are a party to a collective bargaining agreement that has an arbitration clause, or you have a -- or you are a party to or you - either receive benefits from that agreement, and even if you are not on the agreement, you are really just a me too. THE COURT: I really appreciate, Mr. Feldman, you trying to teach me the law of -- MR. FELDMAN: I'm just -- THE COURT: No. But even as you describe it, you are trying to use it offensively against an entity that according to the complaint your client harmed by taking their products. I'm not there, sir. I keep asking you, and I'm not sure why you are refusing to answer me. I am asking you how you put together the actual memorandum you filed by me, which has none of this discussion of the arbitration issues with Amazon.

Mr. Feldman offered this screenshot and pointed to the third result to argue that "it is without question that the citation [included in his reply brief] does exist." (Dkt. #183). Significantly, however, while the third result is a real case citation, the citation does not match the one in Mr. Feldman's reply brief. As for the case name, the reply brief cited "Himmelstein [v.] Comcast of the D.C., LLC," but the screenshot returns a result for "Himmelstein v. Comcast of the Dist., LLC." (Dkt. #180 at 11 (emphasis added); Dkt. #183 at 1 (emphasis added)). As for the reporter citation, the reply brief cited, in relevant part, 44 F. Supp. 3d 1 (D.D.C. 2012), but the screenshot showed a citation for 931 F. Supp. 2d 48 (D.D.C. 2013). What is more, even without reading the case appearing as the third result (which the Court views as the baseline), it should give any reasonable lawyer pause to cite a federal case from the D.D.C. while discussing New York state law. Indeed, as it turns out, this third result is a Fair Credit Reporting Act case and makes no mention of GBL § 349. Himmelstein v. Comcast of the Dist., L.L.C., 931 F. Supp. 2d 48 (D.D.C. 2013).2
