It was such a privilege to work with @nwdonahue.bsky.social and the fantastic lawyers at Patterson Belknap on this amicus brief for the Slaughter case, about whether Trump can fire the commissioners of the FTC.

The brief recovers crucial history the Court and most lawyers have missed. 1/3

The last month of the anti-Mamdani campaign was an absolutely shameful undertaking, an attempt to rip the city and Democratic coalition apart and I'm very happy to see it failed.

If Mamdani wins I will leave New York. I will go live in one of the other 5 houses I have, perhaps the one in South Florida, or the one in Paris, or Napa, or Cabo, but I will definitely leave New York. I will keep my apartment, though, because it's awesome and New York is great. But I will leave.

This is also how they’ll cover him if he wins. Mamdani - all democrats who actually want to govern and fix things - need to understand the NYT politics team as a partisan force arrayed against them.
I genuinely wonder if anyone on the NYT editorial team looks at the Mamdani coverage in total and thinks "yeah, we got this one right"
The story on the eve of the election is basically reporters asking the public "is Mamdani experienced enough?"

No actual news.

At one point this guy is like “I’m not arguing the merits of it, but the politics” and why the fuck not dude?! Maybe the problem with the media is that you’re NOT ARGUING THE MERITS OF IF SOMETHING IS TRUE OR NOT
DOKOUPIL: Republicans says what you're really fighting for is taxpayer dollars for illegal aliens. I know that's not strictly true--

ELIZABETH WARREN: Excuse me, not strictly true? It is a flat out lie!

I continue to think that one of the reasons this country is falling apart is the wholesale abandonment of public virtue as a broadly shared aspiration. Or even something people should be embarrassed about if they don’t have it.

genuinely crazy to me how unitary executive advocates read the vesting clause as granting a huge scope of essentially royal "inherent" powers. one would think that if the framers intended to give the president royal authority, they would have just said so.

This is so incredibly clear to some and i think perhaps still obscure to others. It's not an abstract thought or a gotcha. It's a sinking, gut feeling re: a causal pattern you recognize playing out on a much greater scale. Exactly how it felt in fall 2023 in the first place.
a key reason they see an opening for such a blatant speech crackdown is that they already did one to Palestinian and anti-genocide activists and it got enthusiastic bipartisan approval

Whenever I meet someone who hasn’t seen Sneakers, I like to just list the cast and see them assume the movie is basically Lincoln, which it…is not. (It’s better!)
What a gem of a movie. I ran into David Strathairn at Vetri in Philly while he was doing a play at the Wilma and when I shook his hand I said "Sneakers is one of my all time favorites" and he said "most fun I ever had and hardly anyone brings it up"

Gonna watch it tonight.
I wrote about Robert Redford's environmentalism and, obviously, Sneakers.

Zohran Mamdani's slogan is "for a New York you can afford"

And Andrew Cuomo is now running on a platform of only letting New Yorkers rent apartments that, by definition, they cannot afford.

In urban policy, it is considered bad for someone to be rent-burdened (spending at least 30% of their income on rent). But Cuomo's newly proposed law would *require* that people be rent-burdened. Absolutely insane.
