1) we are trying to compel them to stop, not deter them from starting

2) deterrence / compellence is not predicated on “something they can’t fight against”

This is perfect. The DOJ's embarrassing snafu with disappearing redactions was the fault of Elon Musk. Musk cancelled government subscriptions to Adobe programs that would have made the redactions permanent. What a pack of fools.

i spoke with @wsj about the "total 90" trademark dispute. a small company noticed nike's trademark registration for TOTAL 90 had lapsed, so they registered it & started using it on related goods & then sued nike for infringing it...
