One of the defining feelings in American life, for decades now, is elites doing plainly criminal shit and nothing at all happening as a result. It is deranging in a way that virtually nothing else is. Media fixates on perceived street lawlessness but shit like this matters much more in my opinion.

the unspoken assumption in this post is that the justices are not political actors and arrived at the immunity decision purely out of jurisprudential reasoning or idealogical lean and had nothing to do with trump being the standard bearer for their party in an election that was months away
Any DOJ/Garland counterfactual also has to reckon with the immunity ruling last year. It doesn’t really matter when or how the cases were brought if that was always going to be the endpoint.
as tempting as it is to blame this on garland personally, I think a lot of it was an ingrained, institutionally cautious culure at doj. it was (before january 2025) a building full of careful, by-the-book people
