a nice reminder of one of the more absurd elements of trump v. u.s., which is roberts’ apparent belief that the constitution was written to remove limits on executive power prospect.org/2025/11/21/r...
The Right-Wing Legal Movement Made Trump a King - The American Prospect
John Roberts created a monster: Donald Trump compressed a solid millennium or two of monarchical misrule into a mere ten months.

It is far past time for state authorities to start arresting and prosecuting ICE agents for this shit. Maybe they are in fact ultimately immune, but put the burden on them to convince a judge of that. Don’t just concede it without a fight.

It seems to me that there is (or at least should be) a difference between 1) the judge dismissing the indictment and 2) the judge finding that the "indictment" is void ab initio because it was never actually voted on by the grand jury. You can't dismiss what never existed in the first place.
/2 There’s a statute that revives and extends the statute of limitations if an indictment is dismissed.

“Write every email as if it will one day be produced in discovery” remains one of the best pieces of advice I have ever gotten (and one more people need drilled into their brains).
Do enough litigation and you realize that most people are positively moronic about what they put in their emails.
of all the atrocities these emails likely allude to, it's still amazing that 'elites' write awful things *in emails*. so above the law, so convinced of their rectitude, so conditioned to impunity.

we are on cycle 2 of Trump narrowly winning an election, governing horribly, destroying Republican electoral viability, and doubling down on everything everyone hates

the narrative the entire decade this has been happening is that Trump embodies the will of the people and Dems must move right

Just in: Zohran Mamdani caught calling someone "bro", but our investigation has unearthed the truth. This person was not, in fact, his biological brother. Why did he lie? Tune in tonight at 10 for this and more breaking news.

I’ve got a take I bet many won’t like: Dem handwringing is mostly pointless. Next elections will be dominated by “do you like all this or not?”

Anti-Trump wasn’t enough in 2024 because he wasn’t in office and a chunk of the electorate blamed problems on the party in the White House. That’s changed.

Also someone needs to explain to, not just Rappoport (who is an idiot), but a lot of other people too, that the premise of democratic socialism is not that everyone is poor but that everyone can have nice things and afford an occasional date night out

This is really only tangentially related to the OP, but an idea I‘ve had brewing for a few weeks is that blue states should start passing laws banning taxpayer funds from being used to buy goods or services from companies that do business with the federal government.

Look, I am all for this kind of solidarity, but it is deeply funny that a solid HALF of these countries are currently actual monarchies ruled by a real, honest to god King (or, in Japan’s case, Emperor).

vought justifies all of this as a vision of "separation of powers" — an idea that i'm more and more convinced doesn't actually exist, at least not in any strong form, in the constitution — but the thing that comes across is his basic contempt for representative government

This is nothing more than a continuation of the president’s desperate weaponization of our justice system.

I am not fearful — I am fearless.

the phenomenon that’s been going on for 20 years is more stark than ever: the court tells the conservative legal apparatus what it wants and they go manufacture it.

as true with Heller as it is with birthright citizenship. it’s less balls and strikes and more calling the pitches.
Look at what the United States Government is citing in the birthright citizenship case.

Non-expert legal scholarship and work done hastily in service of their political goals.

Tick, tock.

Lindsey Halligan, the newly-installed prosecutor in EDVA, has less than a week to secure an indictment against James Comey before a key statute of limitations runs out.

Ben Wittes and I examine her charging options.

Spoiler alert: they all suck.

Among the attempts to create hagiographic eulogies of Charlie Kirk, I’ve seen more than a few people suggest that Kirk should be respected for being willing to talk to “those who disagree with him” as a sign that he was engaging in good faith. Perhaps the perfect example of this is Ezra Klein’s silly eulogy claiming that Kirk was “
