This is one of the shared delusions of American Exceptionalism, for traditional conservatives and liberals. They always throw that "peaceful" bit in. In practical reality, you literally cannot engage in protest (peaceful or not) without significant, often violent, harassment by the state.
Peaceful protests, of course, are not “illegal.” A government ban on peaceful protests would violate the First Amendment. The goal here seems to be intimidation and fear to chill free speech.
