What the Supreme Court have clearly failed to grasp is that the purpose of the Gender Reassignment Regulations 1999, Goodwin v UK in 2002, the Gender Recognition Act 2004 and the Equality Act 2010 provisions was to integrate trans people in society, with a small number of exceptions where necessary.

Here, Cross used the words dignity and privacy because they reflect article 8 rights. But I think “dignity and privacy for cis folks but not trans folks” is a perfect article 14 violation. 🙂

Avoiding inconsistent legislative requirements and maintaining the ability to comply with them are also legitimate aims.

You can’t just turn around and say “it doesn’t apply in this case.”
Probably worth noting here that in the Supreme Court submission, the EHRC decided not to bother taking the Human Rights Act into account 🤯
