Excellent, clarifying piece on the (real) legal pathway that Minnesota has to prosecute the ICE agent who shot and killed a woman today.

No, federal agents do not have absolute immunity from start charges, no matter what the Trump administration claims.
Wrote a piece for @slate.com explaining that states have a long history of prosecuting federal officers when they allegedly use excessive force. Federal officers are only immune from such prosecutions when they act reasonably in carrying out lawful duties.

Sure but here’s no provision for “voluntarily surrendering a state’s right to political participation.” In fact you can deprive them of equal representation in the senate without their consent even with an amendment! I do think the Guarantee clause makes sense as the hook here, though.

I mean, Maduro is not the head of state. He lost the election and illegitimately kept power. I don’t think the operation was a good idea and it was obviously unconstitutional and illegal under U.S. law but there’s a clear distinction to be drawn here.
