A federal judge ORDERS the disclosure of James Comey's grand jury minutes to the defense, citing a "disturbing pattern pattern of profound investigative missteps" and casting doubt on Lindsey Halligan's declaration about the gap in the record.

The Court recognizes that the relief sought by the defense is rarely granted. However, the record points to a disturbing pattern of profound investigative missteps, missteps that led an FBI agent and a prosecutor to potentially undermine the integrity of the grand jury proceeding. Therefore, in this case, “the Court has before it a rare example of a criminal defendant who can actually make a ‘particularized and factually based’ showing that grounds exist to support the proposition that irregularities may have occurred in the grand jury proceedings and may justify the dismissal of one or more counts of the indictment.” See Naegele, 474 F. Supp. 2d at 10 (citations omitted). Accordingly, the defense request for all grand jury materials is granted.

The Harvard Crimson Throughout the seven months of correspondence reviewed by The Crimson, Summers and Epstein referred to the woman Summers was pursuing in some messages by the code name "peril" but never used her name in messages directly describing the relationship. On at least two occasions, the two men discussed Jin's emails to Summers, which he forwarded to Epstein. In later messages, the two men appeared to joke about the probability that Summers would have sex with the woman, apparently Jin.

Is it like bad when the prosecutor tells the grand jury that there's no Fifth Amendment right not to testify in your own criminal case?

First, after having advised the grand jurors that the prosecutor was their legal advisor (ECF 178-1 at 46), the prosecutor stated: " (ECF 178-1 at 105) The prosecutor's statement that is a fundamental and highly prejudicial misstatement of the law that suggests to the grand jury that Mr. Comey does not have a Fifth Amendment right not to testify at trial. The prosecutor's statement ignores the foundational rule of law that if Mr. Comey exercised his right not to testify the jury could draw no negative inference from that decision. See Griffin v. California, 380 U.S. 609, 615 (1965) (holding that the Fifth Amendment "forbids either comment by the prosecution on the accused's silence or instructions by the court that such silence is evidence of guilt.") The prosecutor's statement that may have reasonably set an expectation in the minds of the grand jurors that rather than the government bear the burden to prove Mr. Comey's guilt beyond a reasonable doubt at trial, the burden shifts to Mr. Comey to explain away the government's evidence. See Victor v. Nebraska, 511 U.S. 1, 22 (1994) (holding that the Due
