/2 Just to be clear, 5th Circuit Judge Jerry E. Smith’s dissent is wildly emotionally incontinent and so bizarre it can’t even be called unprofessional. If someone I loved wrote it I would be very worried and investigate dementia.

There’s an even bigger problem with Halligan’s “highly prejudicial” misstatements of fundamental tenets of criminal law which suggested that grand jurors did not have to base a finding of probable cause on the actual evidence presented to him. That’s not harmless error 😬
People really should be prepared that the Comey case goes forward with a finding that the indictment fuck-up was harmless error.

So long as the operative counts that were indicted had identical language there's a decent chance some court, whether trial, appeal or SCOTUS finds it was harmless

That's a clear, unambiguously aggressive political view in a politically sensitive opinion.

The sort of thing a healthy 5th Circuit would take steps to sanction.
