I think a big takeaway here is that the judiciary is siding with big business b/c they don't want to play potty police. They accepted the claimant's framing around "biological sex" but revived "putative sex" b/c the practical reality of figuring out "biological sex" in the workplace is impossible.

I think a big takeaway here is that the judiciary is siding with big business b/c they don't want to play potty police. They accepted the claimant's framing around "biological sex" but revived "putative sex" b/c the practical reality of figuring out "biological sex" in the workplace is impossible.
