You're effectively saying is that the "Constitution" and everything that derives from it is a fantasy, and there is no point in basing any argument or action on it. And you're right. We have to accept that, whatever will stop fascism, the things we learned in American government class are not it.
1. Yes, Trump launching a new military operation overseas without Congress’ prior declaration of war or authorization of force is almost certainly unlawful.

2. No, there is no real chance the courts will stop it.

Unfortunately our Constitution means little when the judiciary won’t enforce it.

Some thoughts on what Trump has done in Venezuela and what it might mean for US national security. Caveat: not a Latin America scholar so this is focused on US policy. Clearly huge consequences for Venezuela that others can address.

First, despite the buildup, I didn't think Trump would do it.

Last night's attack was a direct consequence of Congress' failure after Iran.

I wrote ⬇️ about how Congress has a constitutional duty to impeach. Anything less, in response to Trump's unconstitutional act of war, is an abdication of duty.
