Yes. Notably, in 2000 when Congress first mandated biometric entry/exit, the tech was there for fingerprint biometrics, but it wasn't practical enough to be done at scale without creating serious headaches for travelers.
So Congress can create laws/orders ahead of the available technology? They don’t have to wait til the tech is imbedded and it’s more difficult to react?

Congress ordered CBP to create a biometric entry/exit system 25 years ago. The problem was that the tech wasn't there until recently, and the agency never pushed hard for it. In late 2020, CBP proposed a rule to implement it. That rule sat until 2025, when the Trump admin finalized it December 26.
It appears the jetway photos at Logan were part of CBP "biometric exit" program, which has been tested for years but was quietly approved for wider rollout in Sept. (Doesn't explain threats to passenger)

My suspicion is that it'll eventually settle into being the same kind of "opting out" as the TSA checkpoints; if you read the fine print on the sign, you can get begrudging permission. But in the interim, as this is rolled out in places without an automated system, I fully expect problems.
they claim US citizens can "simply" opt out, but anecdotally that option is not being given.
