The more you read up on all this the less sense it makes—and the more we must all ask why full-time, professional, working journalists in corporate media believe a goddamned WORD of what they are being told by DOJ or the FBI, let alone are blithely writing headlines echoing them.

BREAKING: Judge James Boasberg rules for those deported under the Alien Enemies Act on March 15 — certifying a class, finding the U.S. maintained constructive custody over them at CECOT, finding they were not given due process, and ordering return or that such process be given by Jan. 5, 2026.
UNITED STATES DISTRICT COURT FOR THE DISTRICT OF COLUMBIA J.G.G., et al., Plaintiffs, LIYANARA SÁNCHEZ, as next friend on behalf of FRENGEL REYES MOTA, et al., Petitioners-Plaintiffs, V. DONALD J. TRUMP, et al., Respondents-Defendants. Civil Action No. 25-766 (JEB) MEMORANDUM OPINION Nine months ago, six Venezuelan men were hustled out of a detention center in Texas, loaded onto planes, and shipped to an infamous mega-prison in El Salvador with no explanation and no opportunity to challenge the reason for their hasty removal. On behalf of themselves and a putative class of similarly situated detainees, they have turned to the courts to vindicate their constitutional right to due process. These efforts have precipitated multiple trips up and down the assorted tiers of the federal judiciary, complicated by their subsequent transfer to and release in their native Venezuela. After the D.C. Circuit vacated this Court's prior preliminary injunction, Plaintiffs have again moved for an order enjoining the Government to facilitate their return to the United States to pursue their individual habeas claims. The parties then agreed to consolidate this Motion into Cross-Motions for Summary Judgment. The Court ultimately finds that the United States maintained constructive custody over Plaintiffs while they were imprisoned in El Salvador, thus affording the Court habeas jurisdiction 1 Case 1:25-cv-00766-JEB Document 215 Filed 12/22/25 Page 2 of 43 over this action. In addition, it will certify a class of Plaintiffs who were removed on March 15 and seek to enforce their right to a hearing. On the merits, the Court concludes that this class was denied their due-process rights and will thus require the Government to facilitate their ability to obtain such hearing. Our law requires no less. ORDER For the reasons stated in the accompanying Memorandum Opinion, the Court ORDERS that: 1. Plaintiffs' [177] Motion for Summary Judgment is GRANTED; 2. Plaintiffs' [178] Motion for Class Certification is GRANTED; 3. Defendants' [182] Motion for Summary Judgment is DENIED; and 4. Just watched the 60 Minutes segment. Basically it debunks the fundamental claim used by Trump admin that the detainees it sent there are “terrorists” and corroborates torture using clips from El Salvadorean influencers Bukele uses internally. Would be a shock to low information voters, probably

watching the CECOT 60 Minutes segment that CBS suppressed, it’s striking that Weiss specifically called out as unnecessary some of the most rigorous investigative work in the segment, including an explanation of how it was done (by human rights researchers)

The right, along the Roberts Court, is trying to nullify the Reconstruction amendments guaranteeing equality under the law, in order to restore the Antebellum Constitution, which envisions “liberty” as an eternal aristocracy of race and class (gift link) www.theatlantic.com/politics/202...
When the 18th-century writer Samuel Johnson asked why “we hear the loudest yelps for liberty among the drivers of negroes,” he was identifying no mere contradiction, but liberty as it was imagined by men who owned other human beings as property. Slaveholders such as John Calhoun saw slavery as inseparable from their own freedom, and they worried that the false doctrine of abolitionism would eliminate that freedom away. “Already it has taken possession of the pulpit, of the schools, and, to a considerable extent, of the press; those great instruments by which the mind of the rising generation will be formed,” Calhoun said. (It seems the “woke mind virus” was telling lies about the great and benevolent institution of American slavery as far back as two centuries ago.) Defending slavery, however, required invasive uses of power, such as banning antislavery literature and returning escaped Black people to bondage. Many white Americans in the 19th century began to understand that the “Slave Power” curtailed their freedoms as well. And this is what many people forget: Systems of domination rarely spread their blessings widely. The Redemption-era revocation of Black freedoms didn’t result in prosperity for white people writ large, but a Gilded Age in which the upper classes gained unfathomable wealth and economic crises left millions destitute. The nation may have held on to white supremacy, but it also got low wages, a threadbare welfare state, and a society dominated by the rich. Everyone else was too divided by race and class to challenge them.
