This memo is supposedly laying out a legal rationale for blowing up small boats that could easily be intercepted (which would be both legal and smarter strategy)

Adding language trying protect personnel that follow the orders from future prosecution is a confession that the rationale is very weak.
This memo is almost an admission of legal *vulnerability* for those carrying out bombings.

The memo purporting to offer a legal rationale for Caribbean boat strikes is awfully close to “assuming Trump’s lies are true, here’s a law that applies.”

But as @gregsargent.bsky.social notes, by trying to immunize officers who follow the orders, it’s practically a confession that they’re illegal.
Trump's illegal murders in the Caribbean just got worse. An internal DOJ memo on the bombings says the victims are waging war on the US, but per NYT, it extensively cites the WH's *own claims* to this effect as evidence!

Especially given how much is being ignored. Nobody — And I repeat, NOBODY in media is adequately documenting the atrocities happening in Memphis. We are rarely even mentioned among cities under Federal occupation.
It strikes me that it’s going to be up to us to make sure there is a cultural memory for what’s been happening in the last 15 years. It’s clear that if we don’t force a drastic change of perspective on basically every institution, all of this will get memory holed or “reinterpreted” to be less awful

another manifestation of this is when you criticize the right and somebody tsk tsks "they say the same thing about the left," like, yeah, somebody is lying, are you interested in who? because the answer is easily discoverable
Perfect example of political media operating under the post-truth standard that (1) distorts the facts until the parties look approximately equal, and (2) holds “do MAGA voters care?” as a higher standard than “is it true?” or “is it important for the public to know about this?”
