BLS says it relied somewhat on "different cell" imputation in November than it did in September. And no use of "carry-forward." But it isn't providing detail on how it treated October, which is key to understanding these November figures.

U.S. consumer prices were up 2.7 percent from a year earlier in November. "Core" prices, excluding volatile food and fuel, were up 2.6 percent.
Be very cautious with these numbers, though. Shutdown distortions may have biased them down.

it is actually kind of bananas how unitary executive theorists have taken a straightforward clause requiring the president to "faithfully execute the laws" and transformed it into a grant for the exercise of limitless unenumerated power.

The Take Care Clause was a byproduct of the lessons learned from the Glorious Revolution that the executive should not be able to dispense with the law promulgated by the legislature. It was not a constitutional provision to empower the executive branch— but to constrain it!

i closed out my column this week with this preemptive jab at basically every commentator currently looking for ways to say that last night didn’t count
If these elections had gone the other way — if the Democratic Party had underperformed or even lost one of these contests — then every commentator under the sun would say, rightfully, that Democrats were in disarray; that even the president’s deep unpopularity couldn’t keep them afloat with voters. But Tuesday was a Democratic victory. And the party didn’t just win — it won by commanding majorities on virtually every field of play. In polls, in focus groups and now at the ballot box, the public is telling us something very clearly: Trump is simply too much. If this is an opportunity for Democrats to win back lost ground — and it is — then it is also a warning to a Republican Party that has tied its entire identity to the man from Mar-a-Lago.

the other thing about this is that there is no reason to pit these candidates against each other? each are good fits for their respective electorates and each shows the value of vigorous campaigns focused on the stated material problems of voters.

A pro-affordability, anti-Trump-corruption message unites the party. Every candidate can run on that, and every candidate can have their own take to fit that to their constituents. There's really no need to find fights to pick when the party agrees on more than it disagrees

Looking at the Federal Register this morning, DHS is moving up the effective date on a June rule that expanded its authority to charge people for certain criminal conduct around federal buildings. It was originally set to go into effect on January 1. It will now go into effect TOMORROW.
I. Background On June 9, 2025, DHS published a final rule for the protection of federal property (90 FR 24217) (June 2025 rule). That rule implements regulations to protect property and prescribe reasonable penalties for misconduct. Specifically, the June 2025 rule makes the following changes: • Codifies the full scope of DHS’s statutory authority to protect all federal buildings that fall within the jurisdiction of the Department of Homeland Security (DHS), rather than only GSA properties; • Permits the charging of criminal activity occurring off federal property in accordance with 40 U.S.C. 1315 authority; • Modifies the list of prohibited conduct to include, among other things, impersonation of security personnel, trespassing into closed areas, the wearing of masks when committing crimes, and tampering with computer systems; • Updates definitions to account for evolving technologies and emerging threats such as unmanned aircraft and new tobacco products; and • Clarifies and specifies in more detail the definition of “disorderly conduct.” DHS set the effective date for the June 2025 rule at January 1, 2026. DHS included that effective date in the regulatory text. See 90 FR 24217, 24218 (Setting forth effective date in 6 CFR 139.5(e)). As DHS explained in the June 2025 rule, the time was necessary to make preparations such as training officers and publishing new signage. II. Discussion This final rule moves up the effective date of the June 2025 rule and then amends 6 CFR part 139 to reflect the new effective date. The June 2025 rule set the effective date at January 1, 2026. This final rule amends that effective date to Nov. 5, 2025. Thus, through this final rule, the effective date for the regulations under part 139 is Nov. 5, 2025. Finally, DHS, through this final rule, is also changing 6 CFR 139.5(e)—which originally marked January 1, 2026 as the effective date for the regulations published under part 139 of chapter 1 of title 6 of the Code of Federal Regulations—to now reflect the updated effective date as set forth by this final rule.

A simply extraordinary factual finding in Judge William Young's ruling concluding that the Trump administration violated the First Amendment in targeting Mahmoud Khalil and other pro-Palestinian student advocates:

The president violated his oath and his duty to faithfully execute the laws.

The fact that the President is, for all practical purposes, totally immune from any consequences for this conduct, Trump v. United States, 603 U.S. 593 (2024), does not relieve this Court of its duty to find the facts. Fed. R. Civ. P. 52(a).
