Whren greenlit racial discrimination as long as police could articulate some race-neutral reason for the stop. It is literally the silliest case you could cite if the point you were making is that the Fourth Amendment constrains race pretext.

I have no idea what the clerks/BK were thinking.

the inexplicable reality of Gorsuch has always been that he has a deep well of empathy for the victims of atrocities as long as those atrocities are at least 150 years old and no interest in stopping exactly the same behavior if it’s happening currently.
He still seems weirdly correct about big natives cases (Brackeen, San Carlos Apache, Ysleta del Sur Pueblo, Herrera v. Wyoming, Lac du Flambeau Band of Lake Superior Chippewa Indians)

A disturbing update to this story: Despite the fact that he was about to be released from a US prison after completing a sentence here, when Kelvin Membreño was deported to El Salvador he was sent to CECOT prison and remains there. The family has not heard from him since.
NEW — Kelvin Membreño will be deported to El Salvador by ICE tomorrow. He’s the birth father of three US citizen daughters and has become an important part of their lives.

Here their adoptive mother makes a last ditch plea to let him stay in the same country as the girls. A gutting guest essay:

When you add this to Judge Matey's similar dissent earlier this year, you can see that there is an emerging strand of thought among the more radical right-wing jurists that would aim to strip basic rights and freedoms from noncitizens. It's not had any success yet, but its adherents are growing.

My mom is a Vietnamese immigrant and on her immigration papers, she has her name written the Vietnamese way (Last Middle First.) On her Social Security card and driver's license, she has it the European way (First Middle Last.) That would likely be enough for Republicans to strip her citizenship.
What this will mean, in practice, that if you are deemed an enemy of the administration, they will pore through your citizenship application paperwork looking for some reason to retroactively disqualify you.

ICE is going after people who commit fewer crimes than U.S. born citizens. They're robbing people, hurting people, using racial profiling, violating due process, hurting children, and going after American citizens while they do. This is an illegal criminal enterprise from head to toe.

On that last post: I genuinely cannot think of any good-faith reason to bar international adoptions from those 39 countries. Under this new ban, consulates will refuse adoption visas for any baby from Cuba, Haiti, Venezuela, Nigeria, or any of the 39 other countries.
