Whren greenlit racial discrimination as long as police could articulate some race-neutral reason for the stop. It is literally the silliest case you could cite if the point you were making is that the Fourth Amendment constrains race pretext.

I have no idea what the clerks/BK were thinking.

the inexplicable reality of Gorsuch has always been that he has a deep well of empathy for the victims of atrocities as long as those atrocities are at least 150 years old and no interest in stopping exactly the same behavior if it’s happening currently.
He still seems weirdly correct about big natives cases (Brackeen, San Carlos Apache, Ysleta del Sur Pueblo, Herrera v. Wyoming, Lac du Flambeau Band of Lake Superior Chippewa Indians)

Miller is a deranged racist commanding a federal police force J Edgar Hoover could scarcely have imagined in his worst fever dream. Home Depot has become both a site of domestic human rights violations and a town square where thousands of people are defending democracy. It must choose a side. /10

It's hard to know exactly what will happen now, given how unprecedented this is. But Trump and Miller envisioned this as a test of their ability to spread fear of lawless state terror. For now, the lower courts are admirably defending the rule of law. 5/5
