Greg Bovino strikes again.
On October 27, 2025, in response to repeated public statements on the part of the government that violated Local Rule 2.01 and threatened Mr. Abrego’s right to a fair trial, this Court issued an Order (“October 27 Order” or the “Order”) prohibiting “[e]mployees of DOJ and DHS” from making any public extrajudicial statements that “have a substantial likelihood of materially prejudicing [this proceeding], including especially that will interfere with a fair trial.” (Dkt 183 at 2-3 (quoting L. Crim. R. 2.01(a)(1))). The Court instructed counsel for the government to transmit the October 27 Order to DOJ and DHS employees and warned that employees who fail to comply with the Order “may be subject to sanctions.” (Id. at 1, 3). On December 12 and 14, after Mr. Abrego was ordered released from DHS custody, and in flagrant violation of this Court’s Order, Chief Border Patrol Agent Gregory Bovino—a senior DHS officer—appeared on national news to call Mr. Abrego an “alien smuggler,” a “wife beater,” and an “MS-13 gang member,” to attack the judges presiding over Mr. Abrego’s civil and criminal cases as “activist” and “extremist,” and to promise that Mr. Abrego would be taken “out of circulation” and deported. When defense counsel raised these statements with counsel for the government, requesting a retraction, the government simply ignored defense counsel’s request— meaning, the government did not even deign to respond to defense counsel’s email raising the concern. Perhaps that is because there is no defense of Mr. Bovino’s conduct: Mr. Bovino’s statements clearly violate this Court’s October 27 Order. The government’s failure even to acknowledge the issue raises serious questions about its willingness to comply with that Order moving forward.

UNITED STATES DISTRICT COURT FOR THE DISTRICT OF COLUMBIA J.G.G., et al., Plaintiffs, LIYANARA SÁNCHEZ, as next friend on behalf of FRENGEL REYES MOTA, et al., Petitioners-Plaintiffs, V. DONALD J. TRUMP, et al., Respondents-Defendants. Civil Action No. 25-766 (JEB) MEMORANDUM OPINION Nine months ago, six Venezuelan men were hustled out of a detention center in Texas, loaded onto planes, and shipped to an infamous mega-prison in El Salvador with no explanation and no opportunity to challenge the reason for their hasty removal. On behalf of themselves and a putative class of similarly situated detainees, they have turned to the courts to vindicate their constitutional right to due process. These efforts have precipitated multiple trips up and down the assorted tiers of the federal judiciary, complicated by their subsequent transfer to and release in their native Venezuela. After the D.C. Circuit vacated this Court's prior preliminary injunction, Plaintiffs have again moved for an order enjoining the Government to facilitate their return to the United States to pursue their individual habeas claims. The parties then agreed to consolidate this Motion into Cross-Motions for Summary Judgment. The Court ultimately finds that the United States maintained constructive custody over Plaintiffs while they were imprisoned in El Salvador, thus affording the Court habeas jurisdiction 1 Case 1:25-cv-00766-JEB Document 215 Filed 12/22/25 Page 2 of 43 over this action. In addition, it will certify a class of Plaintiffs who were removed on March 15 and seek to enforce their right to a hearing. On the merits, the Court concludes that this class was denied their due-process rights and will thus require the Government to facilitate their ability to obtain such hearing. Our law requires no less. ORDER For the reasons stated in the accompanying Memorandum Opinion, the Court ORDERS that: 1. Plaintiffs' [177] Motion for Summary Judgment is GRANTED; 2. Plaintiffs' [178] Motion for Class Certification is GRANTED; 3. Defendants' [182] Motion for Summary Judgment is DENIED; and 4. Democrats in Congress have thus far failed to make a stink out of Pam Bondi's ethical conflicts (some of which she tried to hide during confirmation), most notably w/GEO and Qatar.

But Luigi Mangione's defense team may force that issue, claiming she had conflict bc of past ties to United Health.

These benefits—along with the financial benefits the Attorney General derived from Ballard while she was a partner and while the partnership divided up revenue from UHG—show that the Attorney General has a personal and financial interest in the work Ballard has done on UHG’s behalf. Further, as the Chairperson of Ballard Partner’s Corporate Regulatory Compliance practice, the Attorney General knew or should have known that UHG, the largest and richest health care company in the world with annual revenue of about $400,000,000,000 (four hundred billion dollars), was one of her partnership’s clients, and that she personally financially profited from Ballard’s lucrative relationship with UHG. When Ms. Bondi left Ballard Partners to become the Attorney General in 2025, the very first defendant she personally selected to be executed was the man accused of killing the CEO of her former client. The Attorney General’s financial connection to UHG represents a conflict of interest that should have caused her to recuse herself from making any decisions on this case. Her failure to do so clearly violated the due process rights of Mr. Mangione and provides yet another reason why the Notice of Intent should be stricken.2 2This reply is limited to the due process implications of the Attorney General’s actions personally directing the Department of Justice to seek the death penalty for the alleged murder of her former client’s CEO. The defense will move separately to address the profound conflict of interest implications of this situation. As part of that motion, we will seek discovery, including but not limited to: all communications between UHG, UHC, and Ballard Partners with any employee or representative of the U.S. Government relating to this matter; the terms of Ms. Bondi’s compensation from Ballard, including the revenues that Ballard deri…

For Trump and Miller, the Abrego Garcia case was a crucial gauge of how far they could get in disappearing undesirables and placing them beyond the law entirely.
