Glasgow Live: The mum of a teen rape victim who took her own life after being forced to hold up her underwear in court has slammed a ruling that could allow victims to be questioned over their sexual history. Linda Armstrong's daughter died in July 2002 - just weeks after giving evidence against the 15-year-old who had raped her. The 17-year-old from New Cumnock in Ayrshire was told to hold up the thong she was wearing on the night of the attack and was forced to read the words 'Little Devil' written across the front 💔 The case led to the implementation of special measures, such as barrier screens, to protect witnesses and victims. However, last week five Supreme Court judges said excluding evidence about a complainer's credibility or previous and subsequent sexual behaviour was "liable to result in violations of defendants' rights to a fair trial". Now Linda has criticised any relaxation of so-called "rape shield laws" that would allow complainers to be quizzed on their clothing or sexual history - which is currently almost always excluded from trials for sexual offences in Scotland.

I hope people understand just how horrifying this is as a trans person.

You could just be getting in with your life, not doing anything to hurt anyone - and suddenly you find yourself dragged into a horrible legal case where the press is painting your going to the toilet as somehow predatory.

Trans case hears of ‘secret toilet’ An engineer began using a “secret toilet” at her workplace after encountering a transgender colleague in the female bathrooms, an employment tribunal has heard. Maria Kelly said she does not want to “sacrifice my privacy and my dignity” by sharing toilets with a man and is taking legal action against her employer Leonardo UK. She has lodged a complaint alleging harassment, direct and indirect discrimination. Ms Kelly, people and capability lead for the aerospace firm’s electronics department in Edinburgh, said that as someone who suffers from heavy periods, female toilets are important to her as a place of refuge and privacy to deal with them. She told the tribunal in Edinburgh that after encountering a transgender colleague in the female bathrooms she began using two toilets that only women know about. She added: “I don’t know any man who knows about them. I know women who use them because of the increased privacy.” Ms Kelly said she had first become aware of a transgender person using the female toilets in 2019 when a member of staff from an office elsewhere in the UK came to Edinburgh and female colleagues told her about it, seeming “genuinely upset”. She said she did not raise the issue with the company at the time as she feared being labelled “transphobic” or being put on the “naughty list”. Her lawyer Naomi Cunningham asked her for her understanding of what constitutes a man and a woman. She replied: “It’s always been related to sex, so it’s the sex that you were born, so if you were born male you remain male and if you were born female you remain female.” The tribunal continues.

In an "olive branch" Streeting defended everything he did to strip healthcare from young trans people as right and justified and said absolutely nothing about any way he'd move away from that targeted campaign to eradicate trans people.

Come ON @theguardian.com. This is atrocious.

The Information Commissioner's Office has OVERTURNED Defra's decision that my Freedom of Information requests about the "gender critical" SEEN Network's were vexatious. Decision notice IC-355076-L4T7 - should be on their website in due course, but here's a taster

In terms of cumulative burden, the Commissioner has reviewed the list of previous requests from the complainant and notes that the number and frequency of requests do appear to increase from August 2024. He notes that while the requests are predominantly about SEEN, they do request different information about Defra’s intranet, human resources,health and safety reports and branding spend, for example. The Commissioner considers the complainant’s explanation about how the information provided in one request could lead them to ask for further information is reasonable. 36. The Commissioner doesn’t consider it unreasonable that the complainant has asked for internal reviews for some of their requests. While preparing an internal review response does add to Defra’s workload, it’s within the complainant’s right to request this if they are not satisfied with the response received.37. In considering the complainant’s motive, the Commissioner has not been presented with evidence that the complainant is making requests solely with the intention of causing disruption or distress to Defra staff.38. The Commissioner has considered Defra’s assertion that the complainant has made comments on social media that show they are working with others to try and circumvent the FOIA process. The Commissioner notes that the complainant posted about Defra’s reliance on section 14 to refuse their request which prompted others to comment and suggest they could submit similar requests instead. The complainant’s responses to these comments do appear to encourage others to submit similar requests. While this could be viewed as an indication that the 6Reference: IC-355076-L4T7complainant intends to keep on submitting requests about SEEN, it doesn’t provide sufficient evidence that the complainant is working with others to purposely submit requests that will cause disproportionate burden on Defra.39. 40.
