Wow. Genuinely shocked, and a hugely consequential decision.

Importantly, this is a case where @martylederman.bsky.social's amicus brief appears to have made a MAJOR impact. Before he wrote it, courts were sidestepping the "regular forces" issue entirely. And that's what the Trump admin lost on.

Very interesting: Washington Supreme Court Justice Mary Yu (who's retiring soon) won't apply equal protection to invalidate discrimination against the poor because she's afraid of giving SCOTUS an opportunity to further weaken the 14th Amendment. Remarkably candid. www.courts.wa.gov/opinions/pdf...

Unfortunately, under our Kavanaugh Stops regime, it is entirely rational for anyone who appears Hispanic to carry proof of citizenship at all times. The worst part is that it might not be enough: ICE/CBP keep arresting people who have proof of citizenship, refusing to accept its validity.
U.S. Latinos are now more worried about being asked to prove their legal status during their daily activities (43% today vs. 31% in March), and roughly 1 in 5 have changed their daily routines because of it.

Remember that Trump and his propagandists tried to gaslight you into believing there was no percentage in taking on this fight, that it was hopeless. And a certain cadre of pundits tried to persuade you that Dems didn't dare discuss this in public.

Still not over yet but a big step forward.
HUGE. Judge Xinis grants the writ of habeas corpus and orders that the government "SHALL release [Kilmar] Abrego Garcia from ICE custody immediately."

So this take is spreading around a lot, and I want to put a little caution.

The NDAA is a bill that passes yearly, only applies to this year.

The “definition of sex” applies only to athletics and only to military cadets, so not other athletes.

It is still a bad bill, for many reasons.

1. In exchange for her NDAA vote, MTG has announced that her national felony trans youth care ban will go to the floor December 17th.

It is not expected to pass into law due to the U.S. Senate.

Still, it will be a terrible historic moment for anti-trans bills.

Though the bill stands little chance of becoming law, it will be a major messaging vote for congresspeople on both sides of the aisle.

Democrats—if they take back the House—already needed to launch an investigation into Bove’s egregious criminal conduct on Trump’s behalf before his confirmation to the 3rd Circuit. But they should also look into his brazen partisanship, which obviously violates the judicial Code of Conduct.

Given how this argument is proceeding, I wonder about the choice not to put up an advocate who would just speak ... a little more frankly to the justices?

I assume Amit Agarwal was chosen to defend independent agencies at the Supreme Court today because he's a former Alito and Kavanaugh clerk with a conservative pedigree. But he is doing a very poor job, and I think a progressive advocate with subject matter expertise would've been far more effective.

During ratification of the 14th Amendment, senators discussed whether the Citizenship Clause would apply to the children of immigrants and resoundingly concluded that it did. The evidence is the text. All you have to do is read the Constitution.

That would be bills passed _by the House_. There have only been 38 public laws fully passed this year, 16 of which were Congressional Review Act resolutions, two were continuing resolutions, one renamed a wildlife refuge, one renamed a national historic site, and one renamed a VA clinic.
The House GOP is listing all of its accomplishments. One thing to note: they are still calling the One Big Big Beautiful Bill Act the “Working Families Tax Cut” with OBBB in parentheses.
