The hate groups provisions in the hate speech bill are deeply flawed. They still exclude advocating genocide from the definition of hate crimes, and they will be open to misuse to target peaceful activist groups because of political influence. They shouldn't be passed into law in their current form.

The test of “might” commit a criminal offence is not a test at all. That can be applied to any person, and is effectively an open veto in the hands of the Minister. These changes seek to scapegoat migrants for the hateful anti-Semitic attack on Bondi and are neither proportionate nor fair.

The Minister is required to get advice from ASIO before banning a group and agreement from the Attorney General. Let’s be clear that this is all the same club. ASIO works under the exclusive direction of Labor and Coalition and the AG is from the same political party as the Home Affairs Minister.

The banning power says the “Minister is not required to observe any requirements of procedural fairness” before criminalising and banning an organisation (and exposing current and former members to criminal prosecution). These are Trumpian powers, removing the usual checks for good decision-making.

This means the banning power can be used when hateful conduct is directed at Judaism but not at Islam, Hinduism, Christianity or any other religion. It also does not apply to hateful conduct against the LGBTIQ+ community, women or people with disability. It deliberately carves them out.

Labor is rushing a 144-page omnibus mess through parliament with just 48 hours for public submissions. Communities are fearful this is designed to criminalize people calling out genocide in Gaza. You have my word that we won't let Labor silence dissent.

In their rush to scapegoat migrants, Labor proposes giving the Immigration Minister god-like powers to refuse or cancel visas because someone 'might' commit an offence. That is grossly unfair and cannot be supported.

In Albo's new antisemitism bill, the definition of "hate crime", which underpins the new regime to proscribe "hate groups" like the Nazis, specifically excludes "advocating genocide". That is, advocating genocide is treated as not being a racist hate crime. Now, why would that be?
