NEW: Rad Power Bikes has told employees it will go out of business in January without new funding.

The company said in a staff email that it had a "very promising" option to stay alive, but whatever that was, it fell apart.

It is a neighborhood group: four people were kidnapped at the corner drugstore. A friend a mile away sends a Slack message: she was at the scene when masked men assaulted and abducted two people on the street. A plumber working on my pipes is distraught, and I find out that two of his employees were kidnapped that morning. A week later it happens again. An email arrives. Agents with guns have chased a teacher into the school where she works. They did not have a warrant. They dragged her away, ignoring her and her colleagues’ pleas to show proof of her documentation. That evening I stand a few feet from the parents of Rayito de Sol and listen to them describe, with anguish, how good Ms. Diana was to their children. What it is like to have strangers with guns traumatize your kids. For a teacher to hide a three-year-old child for fear they might be killed. How their relatives will no longer leave the house. I hear the pain and fury in their voices, and I wonder who will be next. Understand what it is to pray in Chicago. On September 19th, Reverend David Black, lead pastor at First Presbyterian Church of Chicago, was praying outside the ICE detention center in Broadview when a DHS agent shot him in the head with pepper balls. Pepper balls are never supposed to be fired at the head because they can seriously injure, or even kill. “We could hear them laughing as they were shooting us from the roof,” Black recalled. He is not the only member of the clergy ICE has assaulted. I received this email about Democrats caving to end the shutdown from one of the SNAP recipients I spoke to:
I'm sorry, I know this is not your problem, but I just felt like screaming into a void seeing that now Dems may cave and end the shutdown without getting anything they were supposedly fighting for. We've been put through hell for weeks, constantly having our ability to simply feed ourselves dangled in front of our faces, our survival used as a bargaining chip, told it was for a reason. Our suffering would prevent even more suffering and that it would be temporary and worth it to save healthcare for millions. And now it's all for nothing. They stood for nothing. They caused suffering for no reason. They'll cause even more suffering for no reason. It wasn't 40 million people starving that made them cave. They were willing to put up with that. But the threat of holiday traveling being disrupted seems to be the thing to push them to give in. They have failed everyone. I'm so angry.

BREAKING: The First Circuit denies DOJ’s stay request in the SNAP case, refusing to stay the Nov. 6 enforcement order.

Justice Jackson’s 48-hour clock started just before midnight Sunday, meaning the administrative stay she issued Friday ends at the end of the day Tuesday.
But the district court did not order the government to use the Section 32 fund until November 6. It did so after it concluded that the government had failed to comply with its October 31 TRO. As a remedy for that noncompliance, the court ordered the government to make the full payment of November SNAP benefits by November 7. Thus, even if we were to stay the second TRO, the government could not obtain the relief that it seeks unless it also meets its burden under the stay factors as to the enforcement order. For the reasons that follow, we conclude that the government has failed to meet the stay factors as to the enforcement order, and we deny a stay of that order. In any event, the district court has now found that the government failed to comply with that October 31 TRO, from which no stay was sought and no appeal was taken that would have prevented the order from taking effect during the period of alleged noncompliance. Thus, for present purposes, the question that the government's motion to stay the enforcement order presents is this: Has the government made a strong showing that it is likely to succeed in establishing either (a) that the district court erred in finding noncompliance with the October 31 TRO or (b) that, insofar as it did not err in that regard, it could not order full funding in consequence of that noncompliance? As we have explained, the answer is no. In the single paragraph it devotes in its stay motion to addressing the enforcement order, the government does not make a strong showing of likely success in either respect. And in the only other passage of the stay motion that could be read to address the finding of noncompliance, the government fails to grapple with the actual basis for that finding.

“Dear President von der Leyen, We, experts in artificial intelligence (Al) and its societal impacts, are deeply concerned about your unscientific and inaccurate statement that Al is nearing human reasoning. You claimed in your budget speech in May "we thought Al would only approach human reasoning around 2050. Now we expect this to happen already next year." We understand from Commission disclosure, which followed a lengthy process to obtain this information, that you relied on the statements of Dario Amodei, Jensen Huang and Sam Altman as the basis for your statement about Al nearing human reasoning. These are marketing statements driven by profit-motive and ideology rather than empirical evidence and formal proof. In short, these tech CEOs claims concerning "superintelligence" and "AGI" are manifestly bound with their financial imperatives and not rigorous science. For the President of the European Commission to repeat the misleading marketing language of US technology firms without independent scientific verification undermines Europe's credibility as a reliable and trusted source of scientific knowledge. This is particularly so amidst a significant speculative bubble to which baseless Al hype is contributing. It also undermines the ability of Commission staff to evaluate the claims of Al vendors at a time when the Commission regulates them and procures Al services. The Commission has the duty to diligently assess claims made by industry and to determine with impartial and scholarly analysis where best the objectives of the Union should be pursued. The scientific development of any potentially useful Al is not served by amplifying the unscientific marketing claims of US tech firms. We call on you to: 1. retract your statement on Al approaching human reasoning next year; 2. diligently evaluate other such marketing claims about Al products; and 3. ensure you have the benefit of the necessary impartial scientific advice in future.”
