What did the regulars make of it? Ms. Good’s death was tragic, they said. Horrific. But they also said that she had asked for trouble. “You obey the law officer,” a man in a veteran’s ball cap said, “and question it later.” This is the divide, in a single sentence. In Minneapolis, protesters saw an innocent woman killed by a federal agent and took to the streets. At “the Pickle,” the regulars saw a woman who should have complied. In bars, cafes and coffee shops across rural Minnesota, the same conversations were unfolding. Ms. Good’s death had become a mirror, reflecting back a fracture that had been deepening for years — not just in their state, but across the country, wherever rural areas chafe against the political power of big cities.

In the 90s and early 2000s, the Saskatoon Police Service faced public and legal scrutiny for practicing what became colloquially known as the "Starlight Tours." In summary, a Starlight Tour happens when an Indigenous person, frequently Indigenous men, is picked up by the police at night and abandoned outside of the city limits in subzero termpatures. An egregious abuse of power, tours were carried out in winter, and the men were left to freeze. This practice came to public eye after one man, Darryl Night, survived an attempted tour and filed a complaint against the SPS officers.

Here’s the short version: the law is clear. The Supreme Court explained, in a 2004 case called Hiibel v. Sixth Judicial District, that the police may compel people to show identification (for example on pain of punishment) if, and only if, they have reasonable suspicion of some offense. Reasonable suspicion is a technical term, it essentially means that they must be able to describe specific facts associated with unlawful activity (classic examples involve stuff like someone walking back and forth outside a jewelry store, seemingly “casing” it for a burglary). Peaceful protest, of course, is protected by the First Amendment, and therefore is not grounds for reasonable suspicion of anything. This is complicated in the immigration enforcement context because the Supreme Court has suggested---in some decisions that I frankly think are terrible and inconsistent with the Fifth Amendment---that race can be relevant to reasonable suspicion of undocumented status. The most famous recent example of this of course was Justice Kavanaugh’s concurrence in Noem v. Vasquez Perdomo, the source of the infamous “Kavanaugh stop.” But Kavanaugh’s concurrence isn’t the law, it’s just a concurrence, and neither his opinion nor the cases on which he relied said that race *alone* is enough for reasonable suspicion of undocumented status. There have to be other facts, such as the location in which a person is found (for example near the border, in a place where undocumented day laborers gather, etc.). None of this provides any support for Secretary Noem’s absurd notion that federal law enforcement may demand proof of citizenship from people present at a protest, regardless of their race. Moreover, this demand that people carry proof of their right to be out and about on the public streets is a legacy of some of the worst dictatorships of the 20th century. The Soviet Union infamously made people carry around internal passports as a way of controlling their population. Race-based compulsory identification has an even darker history. South Africa’s Pass Laws are a particularly infamous example, which imposed internal passports on black citizens under the apartheid system. Free countries don’t do that.

A lot of the panic over the alleged "daycare fraud" and the defense of police violence is to sow doubt in the ability of Democratic jurisdictions to manage their elections. Combined with "white replacement," this is bad.
