NEW: The FDA recently approved the contraceptive implant Nexplanon for use up to five years (instead of three). But it also placed the device under a REMS protocol, a special layer of regulation that could affect access.

Many providers did not yet know about the REMS when I contacted them.

Everyone who stands for immigrant rights, reproductive justice, abortion and gender-affirming care access are award-worthy. Immigrant rights, abortion access, and gender-affirming care are intertwined. Each represents the right of bodily autonomy and the freedom to live authentically and safely.

On 1/26, a message was sent to patients at Mary Bridge Children's Hospital stating that they will discontinue offering gender-affirming medical treatment for individuals under 18, effective after this week. Our hearts are with the trans youth who will be negatively impacted. bit.ly/4qSfxlP

BREAKING: Another of DOJ's invasive trans care subpoenas quashed as to patient records. This one was challenged by patients of Children's National Hospital.

III. CONCLUSION The Government has made improper use of a § 3486 administrative subpoena to out Movants for receiving, and their Hospital for providing, healthcare the Executive characterizes as a "stain on our Nation's history." The Subpoena bears no credible connection to an investigation of any statutory violation by the Hospital. Rather, the Subpoena appears to have no purpose other than to intimidate and harass the Hospital and Movants, and those similarly situated. The Government seeks to fulfill its policy agenda through compliance born of fear. Moreover, in the view of the court, the Subpoena is the classic impermissible fishing expedition. The court rejects the Government's suggestions that anonymizing Movants' patient records cures the Subpoena's defects. The Subpoena lacks a legitimate purpose. That cannot be 15 Case 1:25-cv-03780-JRR Document 23 Filed 01/21/26 Page 16 of 16 ameliorated by providing patient records in redacted form. The court declines, however, to quash the Subpoena for persons other than Movants. Although the Subpoena is an overreach untethered to any lawful purpose no matter who seeks protection from the court, Movants have not persuaded the court that they have standing to raise the matter for persons not parties before the court. For the reasons set forth herein, the Motion is GRANTED. A separate order follows.
