Being a historian, people ask me if I think the US is living through Germany 1933.

Painfully obvious point (since I wrote a book on Hurricane Katrina, where the initial lack of federal response was devastating): FEMA exists because states and localities are easily overwhelmed by disasters – which are only growing in scale and intensity. Are we just going to rerun 2005 now?

When I clerked on the Ninth Circuit, I worked on some notable cases over which Judge Coughenour presided. He was very solidly conservative. This just isn't a close question by any mainstream constitutional analysis.
