Genuine question … is it clear that he used his role as a police officer to gain access to CSAM? The clip from judge’s sentencing on TV news seemed to indicate that he got it from internet searches on open websites.

Yeah - it's a tricky one. Even if no-one is arrested/charged for prescribing puberty blockers, is it still a potential breach of medical ethics to do so knowing that it is (at least technically) illegal?

Note Eddie's view on this - he's a better source on admin law issue than I ...
A bit more complicated than lyndon suggests. Unless they amend the empowering provision in the medicines act, if certain of the grounds are successful it'd be very difficult to validly remake substantially the same regs (especially if the sufficiency of evidence ground it upheld).

If that happens, new regulations CAN be made ... but unless the minister is able to do so in a way that cures the original shortcomings, then those new regulations can be challenged in turn .

"The most" that may happen (on full hearing) is that the court finds the regulations in question are "ultra vires" (beyond the power granted to the minister by Parliament) and so void ... either because of the process used to make them, or the evidential basis for doing so, or some mix of the two.

The "safeguards" involved an individual having to hire a lawyer and bring a case before the D Ct (have you checked out the cost of lawyers recently?), and then redoing the entire election (have you seen how much running an election costs?).

In any case, it can't affect the result of THIS petition because there's a statutory bar to challenging the D Ct Judge's order for a new election. Also, I like the substance of the outcome - letting the result stand would have tasted bad. But still ... questions remain about legal methodology.
