challenges to the states banning gay marriage reached SCOTUS, who overturned a 1971 state ruling (Baker v Nelson) and ruled that it was legal nationally and had to be recognized (Obergefell v Hobbs).

The first state to recognize gay marriage, Massachusetts, did so with significant support from(/2)

I thought the same about gay rights.I was 36 when Windsor came down and 39 when Obergefell came down. I remember thinking it takes time to build consensus. I moved to a state that allowed gay marriage and voted for the “best” candidate, even if they were not for gay marriage, which is again at risk.

President Trump has moved the GOP away from its decades-old opposition to same-sex marriage, and public support remains high. Elected Republicans want nothing to do with a campaign to overturn Obergefell v. Hodges. https://www.notus.org/republicans/gay-marriage-midterms-gop

That’s my biggest worries with SCOTUS. I’m more concerned with Lawrence than the Obergefell. Repealing Lawrence will once again criminalize us.
February 16, 2026 at 1:22 PM
I was then told that the Respect for Marriage Act (finally passed in Dec 2022, and which officially repealed DOMA among other things) was actually useless anyway because Obergefell was what mattered. So then what exactly did the Democrats actually do?!
February 16, 2026 at 10:11 AM
I admitted that that was an improvement, but then showed that in fact nothing did change until Obergefell in 2015. And even when they were back in control in Jan 2021 they didn't do anything until July 2022 when Obergefell was threatened following the repeal of Roe v Wade.
February 16, 2026 at 10:03 AM
I was told I was lying (three times in the initial reply) and that the 2012 Democratic platform supported same sex marriage.
February 16, 2026 at 10:03 AM
I had said that Democrats originally opposed it (true) and then nothing changed until Obergefell (also true).

It’s also worth noting that despite transgender women being in locker rooms and playing in sports and trans men carrying children, none of these were issues to anyone prior to 2015, and after conservatives lost the Obergefell decision.

These are things which already had happened, due to Obergefell.

It doesn't make it much of a fight to overturn it at all: The current SCOTUS says only the DoJ has the right to enforce it.

The RFMA did nothing? It officially repealed DOMA, required the federal government to recognize same sex (and interracial) marriages, and compelled all states/territories to do so as well. A reversal of Obergefell would have set things back 10+ years; the RFMA at least makes it a much bigger battle.
February 16, 2026 at 8:47 AM
And can anyone say for sure that they would have even gotten there if Thomas hadn't threatened Obergefell? Why didn't they start pushing the RFMA again first thing in 2021?
February 16, 2026 at 8:19 AM
They had both houses again starting in Jan 2021, but didn't reintroduce the RFMA until after the repeal of Roe in June 2022 when Thomas was suggesting revisiting Obergefell. It passed the House in July, but took until the end of November (after the midterms) to get to 60 votes in the Senate.
February 16, 2026 at 8:19 AM
They controlled the Senate starting in Jan 2013, but not the House, and while Feinstein reintroduced the RFMA in the Senate in June 2013 it just went to the Judiciary committee and that was it.

They were in the minority in both houses starting Jan 2015, and then Obergefell was in June 2015.

On 6/26/15, the Obama administration bathed the north side of the WH in rainbow-colored light to celebrate the Supreme Court’s Friday ruling in Obergefell v. Hodges, which guaranteed a constitutional right to same-sex marriage across America.

Does someone need to point out that you're lying?

Because you're lying.

Why are you lying?

Obergefell was after the platform switched from civil unions to equal marriage: supreme.justia.com/cases/federa...

Does someone really need to point out that Democrats were officially opposed to same sex marriage? It was only the Obergefell ruling that changed things, which was incredibly convenient for Democrats since they never had take a stand on anything.

that's the thing they aren't actually mad about a character they never heard of before spring 2023 and don't care about in 2026. they're mad about Daisuke being the Obergefell v Hodges of losing the culture war over Astolfo and gay girls who love anime

Yglesias and Silver, especially at their peak influence, were also a different era of political media. Sullivan had waned in his posting when 538 and Vox were considered the "must-reads" in the mid 2010's.

IIRC, Sullivan had almost stopped blogging a year before Obergefell.

It’s because 1) Many of them can’t stomach supporting a Dem despite proven fecklessness and 2) Many holding out to get Obergefell overturned.

California, Colorado, Nevada and Hawaii repealed their constitutional bans on same-sex marriage post-Obergefell. In addition, 16 states' remaining statute or constitutional bans on miscegenation were repealed post-Loving.

Project 2025’s claim is that children raised by same-sex parents are "less than" other kids. Groups like the Heritage Foundation want to undo Obergefell. They’re well-funded, well-coordinated and determined. They've attacked transgender rights, HIV funding and have recently brought back Kim Davis.

SCOTUS passed marriage equality in 2015. Obergefell v. Hodges. It is my observation that the many folks I know that are gay are now woven into the culture. Why is there still a need for a flag?

On #ValentinesDay, we're celebrating SCOTUS' landmark marriage equality ruling.

Our opponents are still fighting—but we're winning. Our members successfully removed riders that would've enabled discrimination against same-sex couples from EVERY funding bill that's become law.

Decades later, on June 26, 2015, Obergefell v. Hodges secured marriage equality for same-sex couples—after years of LGBTQ+ organizing and resistance. These rights were fought for, not given.
Coming soon: the BCV docuseries.
