The motion for preliminary injunction to be decided boils down to one question: should
the Court take action to preserve the the Consumer Financial Protection Bureau now, before the
case concerning its fate has been resolved? That is an extraordinary step, and before it can step in,
the Court must conclude that the plaintiffs are likely to succeed on their claims, that they would
suffer irreparable harm in the meantime if the Court lets the lawsuit run its course, and that an
injunction would be in the public interest.

A Skadden attorney resigned today, citing the firm’s decision to strike a deal with Trump amid pressure campaign on law firms.

“[I]f my employer cannot stand up for the rule of law, then I cannot ethically continue to work for them,” the former Skadden lawyer, Brenna Trout Frey, wrote on LinkedIn.

Skadden Resignation
Today the executive partner of my former firm sent us all an
"update" that attempted to convince some of the best minds in the legal profession that he did us a solid by capitulating to the Trump administration's demands for fealty and protection money. Fellow Skadden attorneys: If you agree with Jeremy London's position that the firm should not engage in "illegal DEI discrimination," should devote prestigious Skadden Fellows to the Trump administration's pet projects, and should help "politically disenfranchised groups who have not historically received legal representation from major national law firms," (taking into account the robust pro bono work that major national law firms already do), then by all means continue working there. But if that email struck you as a craven attempt to sacrifice the rule of law for self-preservation, I hope you do some soul-searching over the weekend and join me in sending a message that this is unacceptable (in whatever way you can). As one of my more eloquent former colleagues put it:
"Do not pretend that what is happening is normal or excusable. It isn't."
There is only one acceptable response from attorneys to the Trump administration's demands: The rule of law matters.
The rule of law matters. As an attorney, if my employer cannot stand up for the rule of law, then I cannot ethically continue to work for them.

This reminder about the role of the federal courts seems necessary given the opening line
in defendants’ pending motion, expressing “the need to curtail ongoing improper encroachments
of President Trump’s Executive Power playing out around the country.” Defs.’ Mot. at 1. This
line, which sounds like a talking point from a member of Congress rather than a legal brief from
the United States Department of Justice, has no citation to any legal authority for the simple reason
that the notion expressed reflects a grave misapprehension of our constitutional order.
Adjudicating whether an Executive Branch exercise of power is legal, or not, is actually the job of
the federal courts, and not of the President or the Department of Justice, though vigorous and
rigorous defense of executive actions is both expected and helpful to the courts in resolving legal
issues. Defendants then proceed, in the second line of their pending motion, to describe as
“meritless” every lawsuit challenging the President’s “agenda that the American people elected
him to carry out.” Id. This blanket denigration of the merits of all the lawsuits filed across the
