Section 527 of the 2024 DHS budget bill could not be clearer: DHS may not use any funds to prevent a Member of Congress from entering an immigration detention facility for oversight.

Here is ICE quoting the DHS spokesperson saying Noem herself told ICE to deny Members entry without her sign-off.

Good afternoon, Unfortunately, we’re unable to support a visit to the El Paso facility on 7/9/25. The Department is now requiring requests be made seven (7) calendar days in advance for scheduling. Please let us know whether we can help you schedule a future visit. Statement attributable to DHS Assistant Secretary Tricia McLaughlin: “As ICE law enforcement have seen a surge in assaults, disruptions, and obstructions to enforcement, including by politicians themselves, any requests to tour processing centers and field offices must be approved by the Secretary of Homeland Security. These requests must be part of legitimate congressional oversight activities. As for visits to detention facilities, requests should be made with sufficient time to prevent interference with the President’s Article II authority to oversee executive department functions—a week is sufficient to ensure no intrusion on the President’s constitutional authority. To protect the President’s Article II authority, any request to shorten that time must be approved by the Secretary.” As Department guidance regarding visits to DHS facilities is updated, it will be posted to ice.gov. ICE continues to comply with Sec. 527 but entry into detention facilities may be delayed due to exigent circumstances (including personnel and facility security considerations during protests) or time required to vet requests to ensure they are for legitimate purposes (i.e., oversight, etc.). ICE will continue to take all actions required to faithfully execute Executive Order 14159, Protecting The American People Against Invasion; we defer additional questions regarding visits to DHS facilities, including questions regarding statements by Secretary Noem or Assistant Secretary McLaughlin, to the Department. Let us know whether you have questions or need additional information. Regards, Thanks for your response. Below is section 527 as you noted. As you can see, there is no language in the text that allows ICE to delay oversight performed by a member of Congress for any length of time based on exigent circumstances or time required to vet a request. Our office has a longstanding working relationship with local DHS and ICE entities and we would hope to continue that relationship. As a member of the House Appropriations Subcommittee on Homeland Security, the Congresswoman looks forward to visiting the facility tomorrow and asking questions to relevant staff. (a) None of the funds appropriated or otherwise made available to the Department of Homeland Security by this Act may be used to prevent any of the following persons from entering, for the purpose of conducting oversight, any facility operated by or for the Department of Homeland Security used to detain or otherwise house aliens, or to make any temporary modification at any such facility that in any way alters what is observed by a visiting Member of Congress or such designated employee, compared to what would be observed in the absence of such modification: (1) A Member of Congress. (2) An employee of the United States House of Representatives or the United States Senate designated by such a Member for the purposes of this section. (b) Nothing in this section may be construed to require a Member of Congress to provide prior notice of the intent to enter a facility described in subsection (a) for the purpose of conducting oversight. (c) With respect to individuals described in subsection (a)(2), the Department of Homeland Security may require that a request be made at least 24 hours in advance of an intent to enter a facility described in subsection (a).
