Huge news from Supreme Court -- deciding against Administration stay motion and for reasons advanced by lone amicus from Marty Lederman. We'll repost my discussion with Marty but this is the case I called the Court's moment of truth Going live on substack NOW with @leahlitman.bsky.social

Wow. Genuinely shocked, and a hugely consequential decision.

Importantly, this is a case where @martylederman.bsky.social's amicus brief appears to have made a MAJOR impact. Before he wrote it, courts were sidestepping the "regular forces" issue entirely. And that's what the Trump admin lost on.
NEW: By a 6-3 vote, the Supreme Court blocks Trump’s deployment of the National Guard to Chicago to assist immigration agents. A majority holds that he likely lacks authority to do so. Thomas, Alito, and Gorsuch dissent. www.supremecourt.gov/opinions/25p...

The US Supreme Court rejecting Trump's attempt to federalize the National Guard to do his bidding is very important. It means if Trump tries to send troops out right before the election to intimidate voters or to seize voting machines, the courts can quickly order that to be illegal.

Those opining that it could be fake are missing the point.

It was in Epstein's effects.

If it's fake, it was planted by Trump officials in a way tending to obscure cause of death.

If it's real, it is one of the most damning deathbed allegations ever made in American history.

Either is historic.

And there goes MAGA’s latest talking point.
Bill Clinton just called on Trump to release the full Epstein Files, including all documents mentioning both Trump and Clinton.

“Refusal to do so will confirm the widespread suspicion the DOJ’s actions to date are not about transparency, but about insinuation.”

If you're a staffer at 60 Minutes who worked on that CECOT segment that got yanked by Bari Weiss at the last minute, figure out a way to leak it. Not saying it's an easy decision or there won't be consequences, but ask yourself why you got into journalism in the first place.

Expect a "revolt" among 60 Minutes staff over Bari Weiss pulling the CECOT segment at the last minute, one network insider told me.

Another CBS News reporter added that a Rubicon had been crossed with this decision, which 60 Minutes correspondent Sharyn Alfonsi called "political" and not editorial.

CBS paid the president of the United States millions in bribe money and now they censor news reports so it does not annoy him. I don’t know how much plainer we can put this.

The White House has been caught.

The administration inserted a photo of Bill Clinton, Michael Jackson, and Diana Ross into the Epstein files and falsely implied it showed them with victims.

In reality, it’s a publicly available fundraiser photo featuring Jackson and Ross’s own children.

Quite a night last night. Creighton beat Xavier by 40 points in the Big East season opener. I attended a very enjoyable seasonal beer tasting class at Upstream Brewery. When I got home I was pleased to see Ken’s comment on the speech. I am pleased to share his comment this morning. 🏀🍺💙
Tonight, Donald Trump tried to sell us all a shit sandwich, desperate to convince the American people that he isn't a complete and utter failure.

He’s lost the economy. He’s lost his mind. And next year, he’s going to lose the midterms.

The speech was a clear effort to reset the narrative after a year marked by falling approval ratings.
