"The implication...is that not only noncitizens but also U.S. citizens could be taken off the streets, forced onto planes, and confined to foreign prisons with no opportunity for redress if judicial review is denied unlawfully before removal. History is no stranger to such lawless regimes..."
#BREAKING: 5-4 Court, with Barrett joining the three Dem. appointees in dissent *vacates* Chief Judge Boasberg’s temporary restraining orders in the Alien Enemy Act cases. Judicial review must be available, Court holds, but has to come through habeas petitions:

Wipe your tears.
This is the difficult business of hope and defying expectation.
We do not give up.
We run through the tape.

Y’all aren’t allowed to throw in the towel until I do. 😉

Big breath. Locked in. Let’s do this.

Behold, the leaders of the “party of law and order.” The most blatantly lawless and comically corrupt major politician in history and the Right’s latest icon of white vigilante violence.

An excellent reminder of what “law and order” politics has always been about, what “order” it seeks to protect.

I wrote about Elizabeth Warren's recent comments re: the shooting of the United CEO, which I think were pretty sensible. People lose loved ones every day to what she called the "vile practices" of insurance companies; we need to understand that it’s not just guns—policy kills, too.
Warren said the country feels "cheated" and "ripped" off by the "vile practices of their insurance companies.” She's since been forced to clarify about 100 times that "violence is not the answer."

Kavanaugh does not ever mention those kids who "regret" that their parents took them to the churches where they were abused, which he has funded. Because all of the attacks on trans people are about distracting from the right's organized predation on children.
Kavanaugh also brings up "detransitioners," people who "regret" their decision to transition genders. Like Alito, he cites European countries that are "pulling back" from gender-affirming care for minors, saying it's a "yellow light" or "red light" for the court that Europe is "pumping the brakes."

i think this is right and i will observe that this is essentially the position the court took in plessy v. ferguson, which held that the constitution has no bearing on inequalities of social power
There is a stance I will call "Kavanaugh neutrality" that says the Constitution is "neutral" between vulnerable people and the power of the state and so we will watch and shrug while the vulnerable are beaten up in our presence. #Skrmetti

Law has never been “real.” Law is, (and has always been) about power, relationships, and people’s beliefs in structure. And I’ll be damned if I let people give up to the nihilist vision of Trump without fighting for the ideal of a nation of laws. The game is not over yet. Stop despairing and fight.

A whole lot of politics is, I suspect, driven by people unhappy about their lives for fundamentally apolitical reasons looking for a socially acceptable place to direct their anger and frustration.
Also, some people are just permanently resentful. About a lot of things, if not everything.
I’ve said it before, will doubtless say it again: These folks are going to be permanently resentful because they’re seeking political power as a substitute for cultural power, and it’s never going to give them what they actually want.
