applicability of the epithet state, to a people so low in the grade of

Cherokee Nation, 30 U.S. at 21. Native Americans were not to be treated as “equals to
equals” but, instead, the United States was the conqueror and Native Americans the

In discussing Native Americans, Justice Johnson employed another racist trope
used by judges both before and after him: Native Americans were uncivilized savages.

But I think it very clear that the constitution neither speaks of them as states

And she is right. They do not write opinions because there is rarely legal precedent or sufficiency for their rulings.
As for this case specifically: It is completely unreasonable to conclude that the balance of equities could ever favor the government when the plaintiffs face forced relocation.

Justice Jackson's sharp dissent accuses her Republican-appointed colleagues of abusing the court's shadow docket "to allow this Administration to disrupt as many lives as possible, as quickly as possible." She also takes a dig at their refusal to write opinions explaining their actions.

Just as important: the judge explicitly says the Executive branch is removing people outside of the country quicker than the legal system can react. People are being disappeared to countries where they previously faced torture and abuse when they know a court will stop them.

Just as important: the judge explicitly says the Executive branch is removing people outside of the country quicker than the legal system can react. People are being disappeared to countries where they previously faced torture and abuse when they know a court will stop them.

These warrantless seizures are unreasonable within meaning of the 4A. Where are the lawyers? Is nobody making the argument?
Plainclothes, no information, no warrant, where detentions are largely based on skin color or language spoken.
