2 things about this settlement I am curious about:

1. If it complies with BBB, which set out a plan to phase out SAVE by 2028. A conflict with Congress’ express wishes could be a ripe ground to block this abrupt end to SAVE.
2. Does a settlement like this comply with the APA? @aft.org
ED is jointly proposing a settlement with the state of Missouri that would end the Biden administration's SAVE student loan repayment plan. It's yet another example of agreements between friendly parties replacing traditional lawsuits.

And she is right. They do not write opinions because there is rarely legal precedent or sufficiency for their rulings.

As for this case specifically: It is completely unreasonable to conclude that the balance of equities could ever favor the government when the plaintiffs face forced relocation.
Justice Jackson's sharp dissent accuses her Republican-appointed colleagues of abusing the court's shadow docket "to allow this Administration to disrupt as many lives as possible, as quickly as possible." She also takes a dig at their refusal to write opinions explaining their actions.

Just as important: the judge explicitly says the Executive branch is removing people outside of the country quicker than the legal system can react. People are being disappeared to countries where they previously faced torture and abuse when they know a court will stop them.
JUST IN: A judge concludes the Trump administration sent a man to Mexico to sidestep protections against torture.

He has no criminal history and had legal protection from being sent to his native El Salvador — where it appears Mexico is sending him. www.documentcloud.org/documents/26...

On this Friday night, somehow, I have returned to Korematsu v. United States (1944). It is terrifying how applicable it is to the horrors we witness today. I hope those challenging the Trump administrations invidious discrimination look to each of the three dissenting opinions for guidance.

Judge Breyer's discussion of Executive powers is so clear it genuinely would be worth having in any law school Con law curriculum. (footnote below).

He explains so well the real world application of this doctrine, which gives 1L's and beyond so much trouble. Really enjoyed reading it.

Can we be surprised at all that John Roberts will try to finish what he started in Shelby County? First Roberts declares the 21st century free of racism in electoral politics, and consequently section 5 is moot. Now, the court is set to declare the VRA to be discriminatory against whites.
😬The Supreme Court will consider whether the intentional creation of a majority-minority congressional district violates the 14th or 15th Amendments.

If the answer is yes, SCOTUS will effectively declare that what remains of the Voting Rights Act is unconstitutional. This is very, very ominous.

On direct order from top DHS officials, an order was given to federal agents to take a student into custody and to revoke their status solely and specifically because of their political speech. She was taken off the street, and thrown into a van. Does this sound like America to you?

These warrantless seizures are unreasonable within meaning of the 4A. Where are the lawyers? Is nobody making the argument?

Plainclothes, no information, no warrant, where detentions are largely based on skin color or language spoken.

This is unreasonable, unconscionable, and unconstitutional.
WE HAVE QUESTIONS…

This is a kidnapping. No uniform, no badge, civilian car. Who are they?

ICE? Sanctioned bounty hunters? Either way, they’re grabbing people without warrants.

How often is this happening, and why aren’t more people talking about it? Congress?
