The facts are complicated, but here’s a summary of what appears to have happened based on the filings and today’s hearing:
NEWS: During a hearing in federal court in VA, prosecutors confirmed that the operative indictment in the case against James Comey was never shown to or voted on by the entire grand jury before it was presented in open court.

Defense counsel argued that’s a complete bar to further prosecution

So when she learned the GJ rejected Count 1, Halligan was befuddled, someone said "Just Gaitherize it," but she either (1) didn't know she needed to present the new indictment to the full GJ, or (2) there wasn't enough time to reconvene the full GJ before the SoL ran out, so she tried to fudge it?

The issue here is basically that the actual written document the grand jury returned just said they no-billed the whole thing. We have the GJ foreperson’s word that they *would have* voted out just the other two, but that doesn’t seem to be what actually happened and that’s not good enough.
