Rep. Goldman: “Do you know what other regimes in the 20th century required similar proof of citizenship?…Is Nazi Germany one?”

Lyons: “Yes.”

Goldman: “Is the Soviet Union one?"

Lyons: “Yes, but this is the wrong type of questioning you should be asking me.”

This paper looks to be an exemplar of the "argument that seems self-evident but only after someone else thought of it and wrote it out" genre. It's not that the argument is obvious (derogatory) but so powerful and intuitive that you slap your forehead after reading it (laudatory). Excited to dig in!
Very excited that @gelbach.bsky.social & I will be publishing "Bruen's Tenth Amendment Problem" in the @uchilrev.bsky.social!

Our central arg is that Bruen's erasure of unexercised powers violates the 10th Am's preservation of existing State power. Comments welcome!

The only response here is a motion to enjoin the whole operation

If the government's position is "I'm sorry your honor but we don't be the capacity to both respect constitutional rights and conduct the operation as it is currently being conducted" the answer is "then you must stop the operation"

Really appreciate this clarity of writing from Judge Blackwell: "Continued detention is not lawful just because compliance with release orders is administratively difficult or because an operation has expanded beyond the government's capacity to execute it lawfully."
Judge Blackwell continues:

"Having what you feel are too many detainees, too
many cases, too many deadlines, and not enough
infrastructure to keep up with it all, is not a defense to
continued detention. If anything, it ought to be a warning
sign."
