But I want to give a shout-out to Kira Kelley,

who focused on ICE's horrific treatment of an immigrant prisoner -- all occurring *after* the court had ordered him released
And I would point Your Honor to two declarations in a recent filing, which if Your Honor would permit, I could file in a supplement in this case. The first is a petitioner -- is a affidavit written by my client Oscar. And that was filed at Docket 67, The Advocates for Human Rights, et al., v. The U.S. Department of Homeland Security, et al., Case Number 26-cv-749. And Oscar's declaration is important for a few reasons. One, it articulates just his horrific experience throughout this proceeding. And it's easy for us to see court orders not being complied with and the e-mails back and forth on the computer, but his affidavit really just shows what it's like to experience that and in ways that were personally for me just sickening to read as his attorney. That he was without food. He was without clean clothes. He was subject to physical danger, both through reckless driving of ICE agents transporting him from one location to another, watching people screaming in pain with medical neglect, being exposed to COVID. Just the conditions of his confinement; eating food that he conflated with dog food. That people are just being treated like less than human. And all of this was happening while he had a court order for his release. And while all of this is happening, ICE agents are telling him to self-deport because he's got no chance to get out of there other than self-deport, so he's being deprived of access, and this is all in his affidavit. Myself and his immigration attorney, who's here in the courtroom today, were not able to talk to him. His immigration attorney in particular made diligent efforts to ensure compliance with the court order, and these are e-mails that are in Oscar's case. I think you've seen these. We're trying to get ahold of him. We're trying to get access to him. We're trying to bring him home. And, meanwhile, he is sleeping on the floor, if he gets to sleep at all, and he's being lied to, denied access to phone calls to call his loved ones or his attorneys. I would encourage Your Honor to read this declaration, and I would defer to the Court if you would like me to submit it formally in Oscar's own case. And the second declaration also in The Advocates

They didn't tell me that a judge had ordered my release just five days into my detention. I only knew about the release order through my attorney. 34. My father was deported to Guatemala by ICE after he was detained with me. So was my cousin. They were deported on January 23rd. 35. Right now, I am happy that I have been released. I am grateful I have my family and an attorney. Other people are not so lucky. I am trying to adjust to my life now but am still dealing with the emotional trauma of being detained. When I think of my time in detention, I think of so many ways I could have died there: the way my car was stopped in the middle of the road, the diseases I could have caught at the Whipple, the driver who was falling asleep at the wheel driving us from El Paso to New Mexico, and exposure to COVID multiple times. I declare under penalty of perjury that the foregoing is true and correct. … 25. This Cibola jail was horrible. It was cramped. I was chained up again. The officers mocked me and called me their enemy. They laughed at me. I was kept at the jail for what felt like around three hours. I wasn't given an explanation for why I was there. 26. Security guards then put me on a bus. I think it was around January 27. No one said anything about where I was going. I was handcuffed. It felt like the middle of the night. It was freezing cold in the bus because the driver had the AC on. We had no jackets. The bus eventually took me back to El Paso in the carly morning of Tuesday, January 27th. 27. I was put in a cold cell where I had to sleep on the bare cement floor. Around 10 in the morning my cellmate asked to speak to an ICE officer. Three officers came into the cell so I had a chance to speak to them too. One officer told me that I "had no chance of returning to Minnesota" and that "the best thing for (me] is self-deportation." She told me that if I fought my case, I would spend two to three more months here in El Paso. She offered me $2600 to self-deport. I refused. I wanted to talk to my attorney. They didn't tell me the judge had already ordered my release and return to Minnesota. If I hadn't managed to talk to my attorney who told me a while back that I was ordered released. I might have given up at this point and signed the self-deportation forms because the conditions were so unbearable. … 30. When I was taken back to the detention center from the airport, after missing the flight, I overheard an ICE officer saying in English, "the judge in Minnesota wants this one back." I was put in a cold jail cell again until early next morning (January 28). But again no one had told me directly that a judge had ordered my release … 32. When I arrived in Minneapolis, I was handed off to ICE … I had to sign lots of papers saying that I wasn't going to be a part of any "groups." I didn't know what they meant by "groups." They never told me why I was detained

A written statement from Multnomah County DA Nathan Vasquez on actions by federal agents at Portland's Immigration and Customs Enforcement facility. It states: I have heard from many people about their concerns with the tactics that ICE agents are using to arrest and detain members of our community. I have likewise heard many concerns about how ICE agents have elected to engage with individuals attempting to disrupt their operations at their South Waterfront facility. Let me be clear, I share those concerns. Law enforcement, federal or local, has a responsibility to accomplish their mission while ensuring everyone’s safety. Gratuitous force has no place at any level of law enforcement. We are a nation of laws. Those who enforce those laws must be held to the highest standard of conduct and fidelity to the law whether or not it is convenient to their immediate goals or desires. The Oregon Attorney General’s office has put the federal government on notice of its intent to investigate any case where it appears a federal officer is engaging in conduct beyond the reasonable scope of their duties. My office continues to collaborate with and support the Attorney General’s work. To date my office has not received any formal criminal investigations from law enforcement to review for prosecution involving federal officers injuring people while on duty, and the district attorney’s office does not initiate criminal investigations. However, my office, and those of the other metro-area district attorneys, have committed to evaluating any completed investigations referred to us by the Attorney General for prosecution.

The DA says his office will collaborate with the state attorney general for any state level investigations into federal LE actions. But adds that the county DA can only investigate cases referred to it by local law enforcement. That hasn't happened so far. (4/X)

1/31: Narrowly avoided being arrested when LAPD officers kettled a small group of protesters, legal observers, and press. I ID'd myself as a journalist & tried to leave but an officer claimed I wasn't exempt from dispersal orders & said I would be detained. Luckily another officer let me leave.
