A near perfect circuit split on a very important issue.
But what if a person is not in custody, like Erma? She had no opportunity to challenge her conviction or sentence because she didn't know the prosecutor was moonlighting as a law clerk until years later. 6 circuits say Erma can bring a claim. But 5 say she cannot. 5/

It’s the comments sections of these platforms. I follow reasonable people but then I go to read the comments and then I think it’s amazing organized society exists.
This is a really good response to a lot of the questions about both present and future Bluesky that people keep asking me. I'm going to write something soon about some of this too, but this is great for folks who keep raising the "but won't it turn evil" question...

Yes, all challenges to laws, or in this case arbitrary administrative rules, I like are by default illegitimate.
And if I don’t like the people who decided a certain way then they too are illegitimate.
You can debate logic and reasoning questions like this on legitimacy grounds is dangerous.

I think they're used to looking at courts as neutral instead of asking who appointed the court, who influenced it, whose legal philosophy they're following, and who put *this* case before *this* court at *this* time.

I have no time for headlines that are designed to draw the ire of left-leaning voters. “Trump-appointed judge” is obviously going to have the conversation turn to a Republicans did as if judges are somehow beholden to president that appointed them.

We are a nation of laws, not rules. Agencies shouldn’t be arbitrarily increasing employment costs. That is anti democratic to its cores. People vote on minimum wage laws.
