Not exactly. That's why so many discharge petitions have been brought successfully lately. The increasingly small margin I mentioned means that he does not maintain control of the floor.

They're probably pushing the "domestic terrorist" angle because they are finding out that there are laws that govern law enforcement's rules of engagement about when you can discharge a firearm, even if they are a suspect.
