It's really quite intentional on his part. He has survived and thrived by exploiting the social expectation that it's gauche and rude to accuse people of doing really shocking and scandalous things. That effectively creates an arbitrage opportunity for people who are willing to do the things.

The main upshot of today's birthright citizenship ruling (that I'm still making way through) seems to be that each person victimized by an unconstitutional Trump order has to pretty much sue individually.
Trump is free to act unconstitutionally to everybody individually.

We don’t if they were gang members, only that Trump’s DOJ says they were. But they’ve had no trials. They are “accused.” They are “alleged” to be members of a gang that Trump has named. And now they are vanished.
