BREAKING: The Supreme Court, on a 5-4 vote, ends the TROs in the Alien Enemies Act litigation, holding challenges must be brought in habeas and in the jurisdiction in which detainees are held. The court also holds that notice and an actual opportunity to bring a habeas case must be given.

In fact, it is offensively ridiculous to think that any but a handful of people disappeared by ICE will be able to file habeas corpus, because it relies on them having informed families with connections to available knowledgeable lawyers with time and resources to act instantly.

Jesús Ríos entered the US at a port of entry in 2023 seeking asylum. His wife started the green card process in January.

Like most sent to CECOT, he has no criminal record.

I *guess* the good news is that IF they can get lawyers AND they can afford it, the 130 men already in El Salvador would have jurisdiction to file habeas claims in DC and not TX or LA.
The Supreme Court did not uphold ANY ASPECT of Trump's use of Alien Enemies Act. It said challengers filed in the wrong court. That's bad news for 130 men already deported to El Salvador. But all major questions about Trump's proclamation are unresolved www.politico.com/news/2025/04...

The implications of today’s Alien Enemies Act decision will be clearer after we know what happens to Abrego Garcia. The obligation to provide due process before removal will be hollower if the courts can do nothing to remedy an illegal removal after it is complete.
