BREAKING: Judge James Boasberg rules for those deported under the Alien Enemies Act on March 15 — certifying a class, finding the U.S. maintained constructive custody over them at CECOT, finding they were not given due process, and ordering return or that such process be given by Jan. 5, 2026.
UNITED STATES DISTRICT COURT FOR THE DISTRICT OF COLUMBIA J.G.G., et al., Plaintiffs, LIYANARA SÁNCHEZ, as next friend on behalf of FRENGEL REYES MOTA, et al., Petitioners-Plaintiffs, V. DONALD J. TRUMP, et al., Respondents-Defendants. Civil Action No. 25-766 (JEB) MEMORANDUM OPINION Nine months ago, six Venezuelan men were hustled out of a detention center in Texas, loaded onto planes, and shipped to an infamous mega-prison in El Salvador with no explanation and no opportunity to challenge the reason for their hasty removal. On behalf of themselves and a putative class of similarly situated detainees, they have turned to the courts to vindicate their constitutional right to due process. These efforts have precipitated multiple trips up and down the assorted tiers of the federal judiciary, complicated by their subsequent transfer to and release in their native Venezuela. After the D.C. Circuit vacated this Court's prior preliminary injunction, Plaintiffs have again moved for an order enjoining the Government to facilitate their return to the United States to pursue their individual habeas claims. The parties then agreed to consolidate this Motion into Cross-Motions for Summary Judgment. The Court ultimately finds that the United States maintained constructive custody over Plaintiffs while they were imprisoned in El Salvador, thus affording the Court habeas jurisdiction 1 Case 1:25-cv-00766-JEB Document 215 Filed 12/22/25 Page 2 of 43 over this action. In addition, it will certify a class of Plaintiffs who were removed on March 15 and seek to enforce their right to a hearing. On the merits, the Court concludes that this class was denied their due-process rights and will thus require the Government to facilitate their ability to obtain such hearing. Our law requires no less. ORDER For the reasons stated in the accompanying Memorandum Opinion, the Court ORDERS that: 1. Plaintiffs' [177] Motion for Summary Judgment is GRANTED; 2. Plaintiffs' [178] Motion for Class Certification is GRANTED; 3. Defendants' [182] Motion for Summary Judgment is DENIED; and 4. Tomorrow, the House of Representatives will vote on a bill that bans gender-affirming medical care for any transgender person under 18, and threatens any medical professional providing this care to youth with 10 years in prison.

Update in the case from September over people the Trump administration sent to Ghana, with substantiated fears that at least some were going to be or were sent to countries where the U.S. could not legally send them directly,

DECLARATION OF JONATHAN G. PRATT I, Jonathan G. Pratt, pursuant to 28 U.S.C. § 1746, declare under penalty of perjury as follows: I am the Senior Bureau Official for the Bureau of African Affairs. In that capacity, I am a member of the Senior Foreign Service responsible for, among other things, coordination of the conduct of our diplomatic activities in the countries of Africa. I have served Case 1:25-cv-03135-TSC Document 50 Filed 12/10/25 Page 3 of 3 in this role since July 16, 2025, and previously served as the Principal Deputy Assistant Secretary for the Bureau of African Affairs, among other positions. 2. I am aware that the court has ordered the Government to "file a declaration by today, September 13, 2025, at 9:00PM EST, setting forth the government's efforts, in light of Ghana's transfer of at least one Plaintiff to his home country, to keep Plaintiffs from being removed to their countries of origin or other countries where they fear persecution or torture." This is a huge win that you might have missed last week: we successfully pressured airlines to shut down their data broker, which was selling passenger data to the government without a court order. I'm going to keep at it until other industries to follow suit.

While this EO is much more subtle in the language they use, their intentions have been laid out in court cases across the country. Earlier this year, a district court judge in Texas blocked the Biden HHS protections in court, allowing prospective foster/adoption by vocally unaffirming parents.

Nauseating ruling that previous HHS requirements prohibiting trans children from being placed with deliberately unaffirming foster families violates Texas law. In part, they argue it would interfere with the ability of DFPS to investigate affirming families.

UNITED STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES, et al., Defendants. § § § § § § § § § § § § § Case No. 6:24-cv-348-JDK MEMORANDUM OPINION AND ORDER In 2024, the Department of Health and Human Services (HHS) imposed a nationwide rule requiring experimental and controversial treatment on our nation’s most vulnerable: children in foster care. The problem for HHS here is that the agency lacks any statutory authority to do so. Finally, the Rule likely conflicts with Texas law. For example, Texas prohibits providing to minors several medical procedures for "the purpose of transitioning a child's biological sex" or "affirming the child's perception of the child's sex" if "inconsistent with the child's biological sex. See TEX. HEALTH & SAFETY CODE $ 161.702; Docket No. 19-1 41 16-17 (noting that such procedures may constitute child abuse under Texas law). These prohibitions are inconsistent with the Final Rule, which requires that "LGBTQI+ children receive an environment that will "support the child's LGBTQI+ status or identity and "facilitate" the child's access to "age- or developmentally appropriate services that are supportive of their sexual orientation and gender identity or expression. 45 C.F.R. $ 1355.22()(1)@)-(ii), (e). Nor could DFPS investigate potential child abuse or prohibited medical procedures without violating the Final Rule's retaliation provisions, which bar any attempt at "conversion therapy, the restriction of a "LGBTQI+ child's" access to "age- or developmentally appropriate materials, the disclosure of a child's perceived "LGBTQI+ status or identity" in a way that causes harm or risk to the child, using information about the child's claimed "LGBTQI+ status or identity" to initiate or sustain a child protection investigation, or taking action against caregivers who support a child's purported "LGBTQI+ status or identity. Id. $ 1355.22(d)(2)(i)-(vi). This conflict between Texas law and the Final Rule constitutes irreparable harm. See Texas v. Becerra, 2024 WL 3297147, at *10 (holding that irreparable injury occurs where a federal agency interferes with the enforcement of state law) (collecting cases); Wyeth v. Levine, 555 U.S. 555, 576 (2009) (recognizing that "an agency regulation with the force of law can pre-empt conflicting state requirements") Signature page the reasons stated above, Texas's motion (Docket No. 19) is GRANTED.
