The DC Circuit has 8 Dem appointees and 4 Republican appointees and yet somehow, Katsas and Rao continue to be on so many consequential panel decisions. Motions panels are one thing (since they are assigned for a month) but merits panels that are randomly assigned seem to favor them as well.

So as best as I can tell, this case was submitted to the DC motions panel in March who issued an admin stay. They then passed it on to the April motions panel that had Katsas and Rao to get briefed on and rule on the motion for stay pending appeal. It then took them 8 months to do so.
Can someone please explain to me how the hell Katsas and Rao are on every single fucking major decision in the DC Circuit upholding Trump admin policy. This is absolutely insane.
