Before folks overreact to headlines about the judge’s ruling in the Khalil case, please note that (1) it was an immigration judge (IJ), not a federal district court; and (2) the IJ had no power to consider Khalil’s constitutional objections.

Really important to know: right now, his lawyers cannot litigate the serious first amendment issues that the law creates. Those issues will actually not be appealable until they get to the circuit court stage.

NEW: Judge Boasberg grants TRO preventing deportation of all in US custody subject to new Trump EO! Concludes that terms like "nation" and "government" likely don't apply to Tren de Aragua, immigration doesn't seem to be "invasion," so Alien Enemies Act wouldn't provide basis for removal.

I’ve been suggesting on TV and podcasts—without actual evidence(!)—that it may turn out that DOJ will wind up not having enough lawyers to defend all the lawsuits challenging this administration’s illegal conduct.
