So the Trump administration’s argument is that this dude, not a court, should have the final say on who ends up in an El Salvadoran prison.

Does that make you feel safer in America?
Presented with evidence that innocent people who are not members of any gang were wrongly deported to a slave prison in El Salvador, Homan flatly insists that all of them were in fact gang members (but he's unwilling to detail any evidence showing it)

Also, historical note: When President Lincoln *actually suspended* habeas corpus under the Suspension Act of 1863, he was required to provide lists of all people detained who were not POWs to the circuit court. He complied. While prosecuting an *actual war*. (This is Milligan)

People need to be crystal clear about something: The requirement that the government ANSWER to a court on the legal basis for detaining someone is literally the core liberty right (habeas corpus). If the government says they don’t have to do that bc “national security,” YOU can be disappeared.
