If the Supreme Court thinks universal injunctions are unconstitutional, to wait until *now* to say that, in this of all cases, with this of all presidents, is a devastating indictment of both its impartiality and its prudence.

I'm writing this post in high dudgeon because what the Court endorsed today is unamerican and contemptuous not just of the role of the judiciary but also of the responsibility we have as a nation to those in our custody and those we subject to punishment.

I'm mad as hell. You should be too.

ICE operations at immigration courts intensified today. Brief 🧵on what's happening:

- A person facing removal shows up for a hearing.
- At the hearing, ICE unexpectedly asks the immigration judge to dismiss the case without prejudice.
- If the judge says yes, the hearing ends, court is over.

Another report, this one out of Arizona, of people showing up for scheduled immigration court hearings and being detained by federal agents.

They've abandoned any pretense of going after the criminal element first. Now everyone is fair game.
They showed up to immigration court in Phoenix. Then ICE agents surrounded them
"I've never seen action like today ever,” attorney Eugene Delgado said. “This hasn't been the normal practice in Phoenix at all.”

IMPORTANT: David’s research shows even further the depth of the inhumanity at play with the imprisonment without trial of hundreds of men in El Salvador.
Cato has published my comprehensive review of the ~240 Venezuelans the US government renditioned 2 months ago to Salvador’s notorious prison. We identified FIFTY who came legally, never violated any immigration law, but are imprisoned at the US government’s request and at US taxpayer expense.

Your average person doesn’t read Supreme Court (or any court) decisions. And the ones who do are typically other lawyers, who will parse the text very carefully. So who, exactly, is Alito trying to fool with his misleading dissent? Is it supposed to be fodder for Fox News? For Martha? Self-delusion?

Here’s the thing: line officers at DHS routinely lie about stuff like this. Some studies suggest manufactured statements occur in 15-20% of cases, sometimes higher. Border Patrol is the worst offender but ICE does it too.

She's right. You're a lawyer for god's sake, it's your job to fight. The last three months have shown that some people in power are simply too soft for the moment. Toughen up or step aside and let someone with some backbone take over.
Justice Sonia Sotomayor on Thursday night urged the legal profession to toughen up. "If you’re not used to fighting, and losing battles, then don’t become a lawyer," she said. Her remarks came against the backdrop of immense stress on lawyers from the Trump administration.

🧵NEW: The House GOP's reconciliation package would DRAMATICALLY reshape immigration via fees, and as noted below, undermine judges' contempt powers.

First, one big change would be an $1,000 fee to apply for asylum, plus $550 every 6 months for work permits and $100 for every year the case drags on.
The House Judiciary Cmt released their reconciliation bill.

In addition to immigration measures, it transfers *all* FTC antitrust actions to the attorney general, among other antitrust provisions, plus does the following w/ courts

ICE threatening charges against people for asking supposed officers to show their badges is weakness. Not succeeding where they hoped to, left relying on threats that likely won’t go anywhere in court (harassment isn’t nothing, but it’s limited).

It’s a sign to resist their abuses more, not less.
