If the Supreme Court thinks universal injunctions are unconstitutional, to wait until *now* to say that, in this of all cases, with this of all presidents, is a devastating indictment of both its impartiality and its prudence.

I'm writing this post in high dudgeon because what the Court endorsed today is unamerican and contemptuous not just of the role of the judiciary but also of the responsibility we have as a nation to those in our custody and those we subject to punishment.

I'm mad as hell. You should be too.

For more than 70 years, Harvard University ("Harvard" or the "University") has been certified by the federal government to enroll international students under the F-1 visa program, and it has long been designated as an exchange program sponsor to host J-1 nonimmigrants. Harvard has, over this time, developed programs and degrees tailored to its international students, invested millions to recruit the most talented such students, and integrated its international students into all aspects of the Harvard community. Yesterday, the government abruptly revoked that certification without process or cause, to immediate and devastating effect for Harvard and more than 7,000 visa holders. 2. This revocation is a blatant violation of the First Amendment, the Due Process Clause, and the Administrative Procedure Act. It is the latest act by the government in clear retaliation for Harvard exercising its First Amendment rights to reject the government's demands to control Harvard's governance, curriculum, and the "ideology" of its faculty and students. The government's actions are unlawful for other equally clear and pernicious reasons. They disregard the government's own regulations-under which Harvard should remain certified to host F-1 and J-1 visa holders. They depart from decades of settled practice and come without rational explanation. And they were carried out abruptly without any of the robust procedures the government has established to prevent just this type of upheaval to thousands of students' lives. 3. With the stroke of a pen, the government has sought to erase a quarter of Harvard's student body, international students who contribute significantly to the University and its mission. - At the hearing, ICE unexpectedly asks the immigration judge to dismiss the case without prejudice.

Another report, this one out of Arizona, of people showing up for scheduled immigration court hearings and being detained by federal agents.

They've abandoned any pretense of going after the criminal element first. Now everyone is fair game.
They showed up to immigration court in Phoenix. Then ICE agents surrounded them
"I've never seen action like today ever,” attorney Eugene Delgado said. “This hasn't been the normal practice in Phoenix at all.”

Kristi Noem's order ending Temporary Protected Status for many Venezuelans, but notes the decision does not address challenges to actions "purport[ing] to invalidate" related legal status, work authorization documents, etc., previously granted under TPS.

Cato has published my comprehensive review of the ~240 Venezuelans the US government renditioned 2 months ago to Salvador’s notorious prison. We identified FIFTY who came legally, never violated any immigration law, but are imprisoned at the US government’s request and at US taxpayer expense.

Your average person doesn’t read Supreme Court (or any court) decisions. And the ones who do are typically other lawyers, who will parse the text very carefully. So who, exactly, is Alito trying to fool with his misleading dissent? Is it supposed to be fodder for Fox News? For Martha? Self-delusion?

Here’s the thing: line officers at DHS routinely lie about stuff like this. Some studies suggest manufactured statements occur in 15-20% of cases, sometimes higher. Border Patrol is the worst offender but ICE does it too.

WHOA. Judge Haines because the first judge to uphold Trump's Alien Enemies Proclamation, out of half a dozen so far. However, she rules that the Trump admin CANNOT rush people onto planes (as they've done multiple times already) and must give three weeks notices ahead of time.
In sum, the Court finds that Respondents must provide to individual detainees who are subject to the AEA and the Proclamation the following notice before removing them pursuant to those provisions of law: (1) twenty-one (21) days notice and an "opportunity to be heard," (2) notice that clearly articulates the fact that the individual detainee is subject to removal under the Proclamation and the AEA, and (3) notice in English and Spanish, the language of those sought to be expelled, and if needed, Spanish-to-English interpreters shall be provided for any necessary hearings. In the case of A.S.R., if Respondents again designate him as subject to the AEA and the Proclamation, they must provide all of the foregoing notice to his counsel at that time.

JUST NOW: A federal judge ordered the immediate release of Rumeysa Ozturk, the Tufts PhD student who was taken on the street in Massachusetts by masked immigration authorities.

Ozturk has been detained in Louisiana for the past 6 weeks. But today, the judge ordered that she be allowed to go home.

ICE threatening charges against people for asking supposed officers to show their badges is weakness. Not succeeding where they hoped to, left relying on threats that likely won’t go anywhere in court (harassment isn’t nothing, but it’s limited).

It’s a sign to resist their abuses more, not less.

NEW! DHS expands on its defiant middle finger to the Supreme Court's ruling that anyone subject to the Alien Enemies Act must get "reasonable time" to be able to "actually seek habeas relief."

They say they're only giving 12 HOURS for people to raise an objection, and 24 HOURS total to sue. Period!
10. As part of the notice procedure, the alien is informed that he or she can make a telephone call to whomever he or she desires, including legal representatives. ICE ensures that telephones are made available for the aliens and that the aliens have access to the telephone lines. 11. Although there may be fact-specific exceptional cases, in a general case, after an alien is served with Form AEA 21-B, the alien is given a reasonable amount of time, and no less than 12 hours, including the ability to make a telephone call, to indicate or express an intent to file a habeas petition. If the alien does not express any such intention, then ICE may proceed with the removal, though such removal may not actually occur for many more hours or days, giving the alien additional time to express an intent. If the alien does express an intent to file a habeas petition, the alien is given a reasonable amount of time, and no less than 24 hours, to actually file that petition. If the alien does not file such a petition within 24 hours, then ICE may proceed with the removal, though such removal may not actually occur for many more hours or days, giving the alien additional time to file the petition. Further, because aliens subject to the AEA are often detained for several days before removal, they frequently have much more time to express an intent to file a habeas petition or to actually file such a petition. Moreover, these timeframes are consistent with, if not more generous than, the timeframes used for expedited removal procedures under Title 8.
