'Some people sympathize with a criminal who is almost certainly going to jail forever' is not, in fact, the same problem as 'armed agents of the state extra-judicially executing someone in broad daylight with total legal impunity.'

There is no legal or ethical justification for killing shipwrecked people in the water, whether or not you’re at war with them. That’s it. No caveats. Not a gray area. In a war it’s a war crime/atrocity. Outside of war, it’s murder. Not sure how else to say it. Everyone involved is implicated.
