I’m more used to saying this to people on the Left than people on the Right, but, “hate speech” is not an exception to the First Amendment. “Hate speech” is protected by the First Amendment unless it falls into a traditional established exception.

For those who missed my earlier, more substantive response to Klein’s piece:
It’s very easy, in these moments, to see who has never had their right to exist peacefully in society on the ballot.

The killing of Kirk is horrible. That’s it. Nothing about the way he practiced politics was good.
“Kirk & I were on different sides of most political arguments. We were on the same side of the continued possibility of American politics.”

So it’s personal? B/c if you were a Black woman or transgender, Kirk would not imagine you having any role in the future of American politics.

Read this whole thread. The EO is a huge regressive step. And Brian's not wrong to be worried about this point in particular. The major theme of Trump II social policy is old-style Poor Law thinking, down to the indoor versus outdoor relief distinction.
It's not at all alarmist to expect that the new network of detention centers will be used to confine unhoused people—and to extract free labor from them. Everything in this executive order points in that direction.

DOJ says it acted pursuant to President’s authority so Grace is out. The question now is will they name Habba to a new 120 day interim US attorney appointment or will they turn to the Vacancies Act and name a different person as acting US attorney.

1. Trump picked Habba as interim US Attorney under 28 USC 546. Technically, the AG is supposed to pick, but whatever. She gets 120 days to serve.

I'm not prone to hyperbole but Trump appointing two absolute freaks to the Office of Legal Counsel is the most ominous step it's taken on abortion.
